13186 RESOLUTION NO. 13186 WHEREAS, the CITY OF MIAMI BEACH, FLORIDA, is the owner in fee of that certain parcel of land located and situate in Biscayne Bay, commonly known as "FLAGLER MEMORIAL ISLAND" , and specifically described as follows : " A certain tract of land in Biscayne Bay in southwest quarter of Section Thirty-three (SW 1/4 of 33) in Town- ship Fifty-three (53) South of Range Forty-two (42) East, having a diameter of four hundred and thirty (430) feet, the center of the tract being twenty- - seven hundred and twenty-five (2725) feet westerly of 14th Street, Miami Beach; twenty hundred and ten (2010) feet southwesterly of Harbor Lane, Belle Isle ; and sixteen hundred and twenty (1620) feet northerly of Star Island, containing three and thirty-three hundredths (3 .33) acres, more or less, together with full riparian rights ." and WHEREAS, a considerable degree of natural erosion on said land, particularly on the east side thereof, where the erosion has so advanced that fill is imperatively required to protect the existing monument, and WHEREAS, the Department of Natural Resources of the State of Florida, by and through K. D. WOODBURN, Chief of the Survey and Management Division thereof, has submitted to the Trustees of the Internal Improvement Trust Fund a Biological Report, as required by law, a copy of said Report being attached hereto, and made a part hereof; and WHEREAS , the CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, has concurrently with the adoption of this Resolution adopted Resolution No. 13187 , calling a Public Hearing for the establishment of an appropriate bulkhead line around said FLAGLER MEMORIAL ISLAND; and WHEREAS, because of the degree of said erosion, time is of the essence in the matter of dredging and filling the eroded por- tion of said FLAGLER MEMORIAL ISLAND; NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, that the Board of Trustees of the Internal Improvement Trust Fund be and it is hereby respect- fully requested for its permit, issued upon an emergency basis, for the dredging and filling of the necessary portions of said FLAGLER MEMORIAL ISLAND to protect the existing monument thereon, said dredging and filling to be confined within the limits of the original Island prior to its erosion, all as set forth in that certain Warranty Deed from THE ALTON BEACH REALTY COMPANY to the CITY OF MIAMI BEACH, a copy of which is attached hereto, and made a part hereof, and said proposed dredging and filling to conform to the limits of the original bulkhead line, as shown by a plan or sketch, prepared by the City Engineer of the CITY OF MIAMI BEACH, FLORIDA, attached hereto, and made a part hereof. This area is also populated by various crabs (e.g. hermit crabs) , some • colonial bryozoans and tube-building polychaete . "The dredge area and the rest of the area to 200 feet or more offshorethe island, is 9d feet • • or greater in depth and has silty bottom with only tube-building polychaetes . "Filling as proposed would liminaa vegetated and productive small area ofbay bottom. "Dredging as proposed would affect a silty ,bay . area of low biological productivity. tr .
