RESOLUTION NO. 13246
WHEREAS, on September 22, 1969, Edward Hardee, while
employed by the City of Miami Beach, Public Works Department,
was injured as a result of a fall from a truck wherein he
received damages to his shoulders, back and a resultant
brain concussion; and
WHEREAS, the injured employee was examined and/or
treated by Drs. Leo Grossman, Alvin Tobis, Michael P. Gordon,
Simon Markovich and Michael M. Gilbert, who treated the
employee by neuropsychiatry for post-traumatic encephalopathy
and evaluated the claimant as having a 10% permanent partial
disability; and
WHEREAS, the court confirmed the findings of Dr.
Gilbert and ordered the City to pay the same; and
WHEREAS, it is felt by the Legal Department that it
is in the best interest of the City to enter into a compro-
mise settlement stipulation under the provisions of §440.20 (10) ,
Florida Statutes, such settlement to be in the total amount of
$3,814.50, payable to the claimant and his attorney; and
WHEREAS, the payment of the sum hereinabove set forth
will discharge forever the City ' s liability of every description
for past, present and future workmen ' s compensation benefits
payable as a result of all the above-enumerated accidents ;
and
WHEREAS, the Order of the Judge of the Industrial
Claims approving the settlement stipulation will not be subject
to modification or review; and
WHEREAS, the City Council deems it to be in the best
interest of the City to enter into a final settlement stipu-
lation upon the terms hereinbefore set forth:
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COUNCIL
OF THE CITY OF MIAMI BEACH, FLORIDA, that the Legal Department
be authorized to enter into final settlement stipulation with
Edward Hardee and his attorney and, if said agreement is ap-
proved by the Judge of Industrial Claims, the Mayor and the
City Clerk-Finance Director be and they are hereby authorized
and directed to comply with the Order of the Judge of Industrial
Claims approving said stipulation.
