13307 RESOLUTION NO. 13307 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, that the Florida State Legislature be, and it is hereby formally requested to favorably consider and enact suitable legislation authorizing and empowering municipalities, which by their Charters, are authorized and have adopted Minimum Housing Standard Ordinances, may also be authorized and empowered to adopt ordinances granting tenants in such municipalities in actions brought by landlords for the recovery of possession of residential property solely for the non-payment of rent, may set off, by equitable defense or otherwise, an amount equal to the' rent claim in the event of an established and proven failure by the landlord to comply with such Minimum Housing Standard Ordinances, and that the inter-position of such defense by the tenant may be lawfully set up in all courts having jurisdiction of causes involving the recovery of possession of rented residential property solely because of an alleged non-payment of rent. BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, that copies of this resolution be transmitted to each member of the Dade County delegation to the Florida. Legislature, the Speaker of the House, and to the President of the Senate. PASSED and ADOPTED this 7th day of July , 1971.
