13357 RESOLUTION NO. 13357 WHEREAS, the State of Florida, Department of Air & Water Pollution Control Board, has held public hearings and meetings, considering generally the application of Chapter 70-82, Florida Statutes, §403. 085, in its application to Dade County and to the City of Miami Beach, and WHEREAS, at a meeting of the said Board, held at the City of Miami Commission Chambers at Dinner Key, Miami, Florida, on August 16, 1971, the said Board heard reports from Metropolitan Dade County, the City of Miami Beach, and other interested parties concerning the result of conferences between the proper officers of the City of Miami Beach, of meetings, studies and negotiations of Metropolitan Dade County, the City of Miami Beach, the City of Miami, and other interested parties, and the proper officers of said governmental agencies, regarding the conclusions and determinations reached as a result of studies and negotiations concerning the most feasible plan for the City of Miami Beach in order to comply with said statutory directive, and WHEREAS, at the conclusion of said meeting, it was determined that the City of Miami Beach should have up to and including August 26, 1971, to reach a determination as to which of its three alternatives it would elect and pursue toward compliance of such statute, and WHEREAS, a special meeting of the City Council of the City of Miami Beach was duly had commencing at 3 :00 o' clock P.M. on the 23rd day of August, 1971, at which time the City Manager of the City of Miami Beach made his recommendation to the said City Council that it should pursue the plan of contracting with the City of Miami to have its sewage treated at the Virginia Key Plant, owned and operated by the City of Miami Water & Sewers Board, which recommendation was approved, passed and adopted unanimously, with one Councilman passing his vote, by the said City Council; NOW. THEREFORE, BE IT DULY RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, that the State of Florida, Department of Air & Water Pollution Control Board, be and it is hereby formally advised and informed that it is the decision and determination of the City Council of the City of Miami Beach, Florida, for itself and on behalf of its citizens, residents and inhabitants, that it has elected to contract with the said City of Miami Water & Sewers Board for the treatment and disposition of its sewage through the facilities presently existing, and to be expanded by the said City of Miami Water & Sewers Board of its Virginia Key installation, and that all steps will be taken expeditiously to formulate a formal document with the City of Miami Water & Sewers Board and the City of Miami, for the implementation and execution of said document, and -1- OFFICE OF CITY ATTORNEY-1130 WASHINGTON AVENUE-MIAMI BEACH, FLORIDA 33139 • BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, that the said City of Miami Water & Sewers Board and the City of Miami are assured of the appreciation of the City Council of the City of Miami Beach, Florida, for the spirit of helpful cooperation for which it has entered into the study of the problems involved, and that the City of Miami Beach and its proper officials look forward to the achievement of a successful culmination of the problems involved, and BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA. for itself and for all its citizens and residents, that it expresses its appreciation to Metropolitan Dade County and its proper officials for the like and similar cooperative spirit of helpfulness with which it engaged in studies and analyses of the complex factors involved in the regional plan formulated by said Metropolitan Dade County.
