13379 RESOLUTION NO. 13379 A RESOLUTION CALLING A PRIMARY ELECTION TO BE HELD ON NOVEMBER 2, 1971, FOR THE NOMINATION OF A MAYOR AND CANDIDATES FOR THE CITY COUNCIL TO BE VOTED UPON AT THE GENERAL ELECTION TO BE HELD ON NOVEMBER 16, 1971; AND PROVIDING FOR THE GENERAL ELECTION TO BE HELD ON NOVEMBER 16, 1971. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA : SECTION 1. That in accordance with the provisions of Section 40 of Chapter 7672, Laws of Florida, Acts of 1917 (the Charter of the City of Miami Beach, Florida) , as amended by Chapter 30981, Laws of Florida, Acts of 1955, and as further amended, a Primary Election is hereby called and directed to be held in the City of Miami Beach, Florida, from 7 :00 o' clock a.m. until 7 :00 o' clock p.m. on November 2, 1971, for the nomination of a Mayor and candidates for City Councilman in Groups IV, V and VI respectively, to be voted upon at the General Election to be held in said City on November 16, 1971. SECTION 2 . That a General Election is hereby called and directed to be held in the City of Miami Beach, Florida, from 7 :00 o ' clock a .m. to 7 :00 o ' clock p.m. on November 16, 1971, for the purpose of electing three (3) City Councilmen in Groups IV, V and VI respectively, and a Mayor, each of whom shall hold office for the terms as provided by law. SECTION 3 . That for the purpose of holding and conducting the said Primary Election to be held on November 2, 1971, and the General Election to be held on November 16, 1971, the City of Miami Beach has been divided into voting precincts and election districts with polling places therein as follows : (Here appears description of polling places -- pages 2, 3, 4 and 5) -1- OFFICE OF CITY ATTORNEY-1130 WASHINGTON AVENUE-MIAMI BEACH, FLORIDA 33139 Pr` SECTION 4. That the City Clerk, who is also the Supervisor of Registration, open the books of said City from 9:00 o' clock a.m. until 5 :00 o' clock p.m. each day, Sundays and Holidays excepted, from September 16, 1971, to and including October 2, 1971, for the purpose of registering electors for the Primary Election to be held on November 2, 1971, and for the General Election to be held November 16, 1971; and that after said October 2, 1971, no elector shall be registered for said elections. SECTION 5. That the City Clerk and Finance Director is hereby directed to publish once each week for a period of four (4) consecutive weeks next preceding said Primary Election in a newspaper of general circulation published in the City of Miami Beach, Florida, a notice of said Primary Election and Registration in substantially the following form, to wit : "NOTICE OF ELECTION NOTICE IS HEREBY GIVEN that by resolution duly passed and adopted by the City Council of the City of Miami Beach, Florida, a Primary Election has been called and will be held in the City of Miami Beach, Florida, from 7 :00 o'clock a.m. until 7 :00 o' clock p.m. on November 2, 1971, at the polling places in the election precincts as follows, to wit : (Here appears description of polling places -- pages 7, 8, 9 a.nd_ 10) -6- OFFICE OF CITY ATTORNEY-1130 WASHINGTON AVENUE-MIAMI BEACH, FLORIDA 33139 at which election the qualified electors participating therein will vote for the nomination of candidates for the office of Mayor and for the nomination of candidates to fill three Council seats for the City Council of the City of Miami Beach, Florida, to be voted upon at the General Election which is to be held on the third Tuesday in November, 1971. The Registration Books of said City will be open from 9 :00 o'clock a.m. until 5 :00 o' clock p.m. each day, Sundays and Holidays excepted, from September 16, 1971, up to and including October 2, 1971, for the purpose of registering any person qualified to vote in said Primary Election. Only persons properly registered will be qualified to vote in said election. " SECTION 6. That the official ballot to be used in such Primary Election shall be in substantially the following form, to wit: "OFFICIAL BALLOT PRIMARY ELECTION FOR NOMINATING CANDIDATES FOR MAYOR AND FOR NOMINATING CANDIDATES TO FILL THREE COUNCIL SEATS of the CITY OF MIAMI BEACH November 2, 1971 MARK A CROSS (X) BEFORE YOUR CHOICE : FOR MAYOR Vote for one (1) only (Here insert names of candidates) MAYOR • • FOR CITY COUNCIL Vote for one (1) only in each Group (Here insert GROUP IV (Here insert GROUP V names of names of candidates) candidates) • • GROUP VI (Here insert names of candidates) -11- OFFICE OF CITY ATTORNEY-1130 WASHINGTON AVENUE-MIAMI BEACH, FLORIDA 33139 • The City Clerk shall prepare the ballot so that the names of qualified candidates for the office of Mayor and City Councilmen will appear on said ballot in alphabetical order according to surname; provided, however, that said ballot and its preparation shall be such as to permit compliance with the Laws of the State of Florida with respect to the use of mechanical voting machines. SECTION 7. That the official ballot to be used in the General Election to be held on November 16, 1971, hereby called, shall be in substantially the following form, to wit : "OFFICIAL BALLOT GENERAL ELECTION FOR ELECTING THE MAYOR AND THREE (3) COUNCILMEN OF THE CITY OF MIAMI BEACH, FLORIDA on November 16, 1971 MARK A CROSS (X) BEFORE YOUR CHOICE : FOR MAYOR Vote for one (1) only (Here insert names of candidates) MAYOR • • • FOR CITY COUNCILMEN Vote for one (1) candidate in each group (Here insert GROUP IV (Here insert GROUP V names of names of candidates) candidates) • • (Here insert GROUP VI names of candidates) • • The City Clerk shall prepare the ballot so that the names of qualified candidates will appear on said ballot in alphabetical order according to surname; provided, however, that said ballot and its preparation shall be such as to permit compliance with the Laws of the State of Florida with respect to the use of mechanical voting machines. -12- OFFICE OF CITY ATTORNEY-1130 WASHINGTON AVENUE-MIAMI BEACH, FLORIDA 33139 • SECTION 8. That the Notice of said General Election shall be given by the City Clerk and Finance Director of the said City by publishing the notice hereinafter provided for, once each week for a period of four (4) consecutive weeks next preceding said General Election in a newspaper of general circulation published in the City of Miami Beach, Florida. SECTION 9. That Notice of said General Election shall be in substantially the following form: "NOTICE OF GENERAL ELECTION NOTICE IS HEREBY GIVEN that by resolution duly passed and adopted by the City Council of the City of Miami Beach a General Election has been called and will be held in the City of Miami Beach, Florida, from 7 :00 o ' clock a.m. until 7 :00 o' clock p.m. on November 16, 1971, for the purpose of electing three City Councilmen and a Mayor who shall hold office for terms as provided by law. For the purpose of holding and conducting said election the City of Miami Beach has been divided into voting precincts or election districts with Polling Places therein as follows : (Here appears description of polling places -- pages 14, 15, 16 and 17) -13- OFFICE OF CITY ATTORNEY-1130 WASHINGTON AVENUE-MIAMI BEACH, FLORIDA 33139 All electors shall vote at the Polling Places in the voting precincts in which the City Registration Books show that said electors reside. The Registration Books of said City shall be open from 9:00 o'clock a.m. until 5 :00 o' clock p.m. each day, Sundays and Holidays excepted, from September 16, 1971, to October 2, 1971, both inclusive, for the purpose of registering any person --a qualified to vote in said election. Only persons properly registered will be qualified to vote in said General Election. " SECTION 10. This resolution shall be effective immediately upon its adoption. PASSED and ADOPTED this 15th day of September, 1971.
