RESOLUTION NO. 13399
WHEREAS the United States of America, through its duly
authorized officers , and by and through the Secretary of the
Army, under authority of Section 4 of the Act of Congress
approved 22 , December, 1944 , as amended, has agreed to lease
to the City of Miami Beach, Florida, for a period of five (5)
years commencing on 1 May, 1970 and ending on 30 April, 1975 ,
approximately 4 . 48 acres of land in the Miami Reservation
Project Area as shown on Exhibit "A" attached to Contract
Number DACW 17-1-73-3, or more generally described as the
easterly portion of the Government Reservation which lies
within the City of Miami Beach, Florida, north of and adjacent
to Government Cut,and subject to the terms and conditions as
set forth in the aforesaid Contract for Lease; and
WHEREAS the City Council of the City of Miami Beach,
Florida, is familiar with the terms of the said Contract
Number DACW 17-1-73-3, and deems it to be in the best interest
of the citizens of the said City of Miami Beach, Florida, to
procure the use of said land for public park and bathing
beach purposes;
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COUNCIL
OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and the
City Clerk-Finance Director be and they are hereby authorized
to execute a lease with the United States of America in
accordance with the terms and provisions of the said Contract
Number DACW 17-1-73-3.
