AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF MIAMI BEACH, FLORIDA, AMEND-
ING ORDINANCE NO. 2g9, BEING THE ZONING
ORDINANCE OF SAID CITY, SO AS TO CHANGE THE
ITEM (1) c UNDER THE TITLE "GENERAL PROVI-
SIONS" WITH REFERENCE TO THE CONSTRUCTION
OF DOCKS, WHARVES, DOLPHINS OR STRUCTURES
EXTENDING INTO BISCAYNE BAY, INDIAN CREEK
AND COLLINS CANAL.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA:
SECTION 1. That Ordinance No. 289 of the City of Miami Beach,
Florida, be and the same is hereby amended as follows:

That Item (1) a under the title "General Provisions,
of Ordinance No. 289, be amended to read as follows:

No dock, wharf, dolphins or structures of any
kind shall be erected, constructed or reconstruct-
ed, so as to extend into Biscayne Bay a distance
greater than twenty-five (25) feet, or so as to
extend into Indian Creek a distance greater than
fifteen (15) feet or so as to extend into Collins
Canal a distance greater than three (3) feet, or
so as to extend into any other waterway in the
City of Miami Beach, a distance greater than five
(5) feet; except that with special permission of
theCity Council, docks, wharves, dolphins or similar
structures may extend from a business or multiple -
family lot into Biscayne Bay a distance not greater
than one hundred (100) feet. No part of any such
dock, wharf, dolphins or structures shall be higher
than two (2) feet above the top of the adjoining
seawall or the established grade for the seawall if
none exists. "
2. All ordinances and parts of Ordinances in conflict here-
with are hereby repealed.
3. This Ordinance shall take effect immediately after its
passage, approval and posting.

Ordinance No. 463 entitled "AN ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF MIAMI BEACH, FLORIDA, AMENDING ORDINANCE NO.
289, BEING THE ZONING ORDINANCE OF SAID CITY, SO AS TO CHANGE
THE ITEM (1) c UNDER THE TITLE "GENERAL PROVISIONS" WITH RE-
FERENCE TO THE CONSTRUCTION OF DOCKS, WHARVES, DOLPHINS OR
STRUCTURES EXTENDING INTO BISCAYNE BAY, INDIAN CREEK AND
COLLINS CANAL", having been duly passed and adopted by the
City Council of the City of Miami Beach, Florida, has been
posted by me in three conspicuous places in the City of Miami
Beach, one of which was at the door of the City Hall in said
City on the day of December, A. D., 1936, and that said
Ordinance remained posted for a period of at least thirty
days in accordance with the requirements of the City Charter
of the said City of Miami Beach.
IN WITNESS WHEREOF I have hereunto set my hand
and affixed the official seal of the City of Miami Beach, Florida,
on this the 8th day of January, A. D., 1937.
