AN ORDINANCE AMENDING ORDINANCE NO. 255 OF
THE CITY OF MIAMI BEACH, FLORIDA, BEING AN
ORDINANCE PROHIBITING THE CARRYING ON OF ANY
BUSINESS IN ANY STREET OR ALLEY OR PART
THEREOF WITHOUT THE CONSENT OF THE OWNER
WHOSE PROPERTY ABUTS ON THE STREET OR ALLEY,
EXCEPT IN A DESIGNATED ZONE, AND PROVIDING
A PENALTY FOR THE VIOLATION THEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA:
SECTION 1:
That Section 1 of Ordinance No. 255 of the
City of Miami Beach, Florida, be and the
same is hereby amended to read as follows:
"Section 1: That on and after the passage of this ordinance,
it shall be unlawful for any person, firm or corporation to
carry on any business of any nature whatsoever in the streets
or alleys of the City of Miami Beach, Florida, without the
consent of the person entitled to possession of the property
abutting on that part of the street or alley, unless such
business be conducted in a place or part of the street or
alley designated by police order."
That any and all persons, firms, . or corporations
SECTION 2: violating the terms of this ordinance shall,
upon conviction, be subject to a fine not to
exceed Two Hundred Dollars (8200.00), or imprisonment for not
more than sixty (60) days, or both, at the discretion of the
Municipal Judge.
All ordinances and parts of ordinances in
SECTION 3: conflict herewith are hereby repealed.
This ordinance is hereby declared to be an
SECTION 4: emergency measure on the ground of urgent
public need for the preservation of peace,
health, safety and property, and shall become effective immediate-
ly upon its passage and approval as such.

Ordinance No. 46 entitled "AN ORDINANCE AMENDING ORDINANCE
NO. 255OF THE CITY OF MIAMI BEACH, FLORIDA, BEING AN ORD_
INANCEPROHIBITING THE CARRYING ON OF ANY BUSINESS IN ANY
STREET OR ALLEY OR PART THEREOF WITHOUT THE CONSENT OF THE
OWNER WHOSE PROPERTY ABUTS ON THE STREET OR ALLEY, EXCEPT
IN A DESIGNATED ZONE, AND PROVIDING A PENALTY FOR THE
VIOLATION THEREOF", having been duly passed and adopted by
the City Council of the City of Miami Beach, Florida, has
been posted by me in three conspicuous places in the City of
Miami Beach, one of which was at the door of the City Hall
in said City on the 10th day of December, A. D., 1936, and
that said Ordinance remained posted for a period of at
least thirty days in accordance with the requirements of
the City Charter of the said City of Miami Beach.
