2001-24676 Reso RESOLUTION NO. 2001-24676 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, SETTING A PUBLIC HEARING ON DECEMBER 19, 2001, TO CONSIDER A REVOCABLE PERMIT REQUEST BY GOLDWATER REALTY VII, INC., OWNER OF PROPERTY AT 1766 BAY ROAD, FOR THE CONSTRUCTION OF A HANDICAP RAMP, CONCRETE STEPS, WALKWAY AND RAILINGS ON THE ADJACENT CITY RIGHT-OF-WAY. WHEREAS, GoldWater Realty VII, Inc. (the Applicant) owns the property located at 1766 Bay Road (the Property) ; and WHEREAS, due to remodelling of the Property, which is built to the property line, a handicap ramp, steps and railings are required by Code; and WHEREAS, the Applicant is requesting to install such ramp, steps and railings in the City right-of-way adjacent to the Property, and as such has applied for a Revocable Permit for the use of said City right-of-way; and WHEREAS, pursuant to the City of Miami Beach Code, Chapter 82, Article III, Division 2, Section 82-93, the Mayor and City Commission are required to hold a public hearing to consider the aforestated request. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CI1Y COMMISSION OF THE CI1Y OF MIAMI BEACH, FLORiDA, that a public hearing to consider a request by GoldWater Realty VII, Inc., as owners of the property located at 1766 Bay Road, to install a handicap access ramp, steps and railings within the City right-of-way, is hereby called to be held before the Mayor and City Commission in their Chambers on the Third Floor of City Hall, 1700 Convention Center Drive, Miami Beach, Florida, on December 19,2001, beginning at 11 :OO'lI.m, and the City Clerk is hereby authorized and directed to publish appropriate Public Notice of the said Public Hearing in a newspaper of Miami Beach, at which time and place all interested parties will be heard. ADMINISTRATION RECOMMENDATION: Adopt the Resolution. BACKGROUND: Pursuant to City Code, Chapter 82, Article m, Division 2, upon receipt of a Revocable Pennit application, the City Commission shall schedule a public hearing to consider the request for use of the public right-of-way. Goldwater Realty VII, Inc., owners of the property located at 1766 Bay Road are remodelling the first floor of this existing building to accommodate a neighborhood bar. In order to meet accessibility and fire protection codes in this building which is built to the property line, the owners are requesting the use of the adjacent parkway within the city-right-way, to install the handicap ramp, concrete steps and the required railings. ANALYSIS: Pursuant to City Code, Chapter 82, Article m, Division 2, Section 82-92, Revocable Permits, the applicant has complied with the application requirements, submitted the application fee and provided a list of property owners within a radius of 375 feet to be notified of the scheduled public hearing. AGENDA ITEM C7K DATE /f-,;;,r-O/ The City Commission is required to schedule a public hearing allowing fifteen days notice to the property owners within 375 feet of the site, in order to consider this application for a Revocable Permit.
