99-23388 Reso , RESOLUTION NO. 99:-~3388 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROPRIATING FUNDS, IN THE AMOUNT OF $55,000, FROM THE FLORIDA DEPARTMENT OF TRANSPORTATION (FDOT) AND WEEKLY ASPHALT PAVING, INC., TO PAY FOR DAMAGES CAUSED TO THE EXISTING IRRIGATION SYSTEM DUE TO THE INSTALLATION OF THE MEDIAN GUARDRAIL ON THE CENTER MEDIAN OF THE MACARTHUR CAUSEWAY, AS STIPULATED IN THE LETTER OF AGREEMENT BETWEEN THE CITY OF MIAMI BEACH AND FDOT, SAID AGREEMENT APPROVED AND ACCEPTED BY THE MAYOR AND CITY COMMISSION ON SEPTEMBER 17,1999; AND ESTABLlSIDNG THE WORK ORDER TO MAKE THE NECESSARY REPAIRS. WHEREAS, in 1994, the Mayor and City Commission approved a Memorandum of Agreement with the Florida Department of Transportation (FOOT) to provide for maintenance of landscaping along the MacArthur Causeway, for a total of $150,000 per year, to be paid to the City; and WHEREAS, in November 1998, the FOOT entered into a contract with Weekly Asphalt Paving, Inc., to install a guardrail along the center median of the MacArthur Causeway; and WHEREAS, during the installation of the guardrail on the above specified medians, the water main for the existing irrigation system was unavoidably damaged; and WHEREAS, the FOOT agreed to compensate the City, in the amount of$55,000, to be utilized to restore the site and offered this to the City via a Letter of Agreement in order to resolve this issue; and WHEREAS, the Mayor and City Commission approved and accepted the Letter of Agreement at its meeting on September 17, 1999; and WHEREAS, in order to proceed with the restoration of this Project, the $55,000 must be appropriated into a Work Order to be established, NOW THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, herein approve an appropriation of funds, in the amount of $55,000, from the Florida Department of Transportation and Weekly Asphalt Paving, Inc" to pay for damages caused to the existing irrigation system, due to the installation of the median guardrail on the center median of the MacArthur Causeway, as stipulated in the Letter of Agreement between the City of Miami Beach and FOOT; said Agreement approved and accepted by the Mayor and City Commission on September 17, 1999; and establishing the Work Order necessary to make the necessary repairs, PASSED and ADOPTED this 17th day of November, 1999 MAYOR ATTEST: ~'r~~ CITY CLERK AfIftfDIED AS TO FORM. lANGUAGE & FOR EXEClJTION JOPIJPIKSlJO/OM F:\RCPA\$ALL\KEVIN\COMM.99\MAC2AP.RES /1i.;.&1 b CITY OF MIAMI BEACH CITY HALL 1700 CONVENTION CENTER DRIVE MIAMI BEACH, FLORIDA 33139 hllp:I\ci,mlaml-beach fl,us ~. ADMINISTRATION RECOMMENDATION: Adopt the Resolution, ANALYSIS: In November 1998, the Florida Department of Transportation (FDOn entered into a contract with Weekly Asphalt Paving, Inc., to install a guardrail along the center median of the MacArthur Causeway and during the installation of the guardrail, the water main for the existing irrigation system was unavoidably damaged, The FDOT agreed to compensate the City, in the amount of $55,000, to be utilized to restore the site, On September 17, 1999, the City Commission approved a Letter of Agreement between the City of Miami Beach and the Florida Department of Transportation (F.D.O,T,) and Weekly Asphalt Paving, to pay the City for $55,000 for damage to the water main for the existing irrigation system. In order to proceed with the restoration of the irrigation system on the MacArthur Causeway, the $55,000 in FDOT funding, accepted by the City Commission on September 17, 1999, should now be appropriated into a Work Order to be established for the ongoing maintenance of the MacArthur Causeway.
