RESOLUTION AUTHORIZING EXECUTION
OF AMENDMENT TO CONTRACT BETWEEN
CITY OF MIAMI BEACH AND CHRIS
DUNDEE ENTERPRISES , INC .
WHEREAS, the City of Miami Beach and Chris Dundee
Enterprises, Inc. , have heretofore entered into an agreement
whereby the latter was granted the exclusive right to present
boxing and wrestling exhibitions, shows and contests at the
Miami Beach Auditorium and Convention Hall under the condi-
tions and provisos therein set forth; and
WHEREAS, following the execution of said agreement,
it has appeared to be necessary and essential that certain
provisions thereof be modified and amended so as to express
the real and true intent of the contracting parties, particu-
larly so as to amend the number of passes authorized to be
issued by the said Chris Dundee Enterprises, Inc. , and to
provide that percentages of receipts payable to the City
shall be computed on the basis of gross receipts after deduc-
tion of taxes so as to express the true intent of the parties,
and to revise said agreement so as to eliminate a certain
conflict or discrepancy as to percentages payable; and
WHEREAS, an appropriate agreement setting forth
said changes and amendments to the said existing agreement
has been duly prepared and has been recommended by the Acting
City Manager and approved as to form by the City Attorney;
and
WHEREAS, the City Council of the City of Miami Beach
deems it to be in the best interest of the City that said
amendment to the said agreement be entered into;
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY
COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor
and the City Clerk-Finance Director be and they are hereby
authorized and directed to execute said Agreement in the name,
and in behalf of the City of Miami Beach, Florida.
PASSED and ADOPTED this 3rd day of January , 1973 .
