RESOLUTION NO. 73-13864
WHEREAS, pursuant to a referendum election held in
the City of Miami Beach, Florida, on April 23, 1970, City Council
was authorized to convey, by appropriate instrument, fee simple
title to Lots 15 through 20, Block 111, Ocean Beach Addition No. 3,
as recorded in Plat Book 2 , at page 81, of the Public Records of
Dade County, Florida, for use as low rent housing for the elderly,
and
WHEREAS , City Council of the City of Miami Beach, Florida,
is also contemplating the construction of a boat marina northerly
and southerly of the above described parcel of land, and
WHEREAS, it will be in the best interest of the parties
that the City be granted or be permitted to retain an easement over,
above, upon and across the west 40 feet of said parcel of land for
pedestrian passage to and from the proposed marina by the public,
together with appropriate riparian rights, and
WHEREAS, the Public Housing Authority is agreeable to
the grant, or the retention of such easement by the City of Miami
Beach upon the condition that the Public Housing Authority shall
be permitted to construct not less than 200 living units on the
parcel of land first described herein and on the further condition
that use of such easement shall not be in derogation of the rights
of the Public Housing _Authority and the persons living in said low
rent housing project, and other conditions all as set forth in a
proposed agreement to be entered into by and between the City of
Miami Beach, the Housing Authority of the City of Miami Beach,
Florida, and E.D.A. , Inc : , a Florida corporation, the latter being
the Developer and Constructor of said housing project, and the
terms and conditions of said agreement being known to the City
Council of the City of Miami Beach, Florida, and the same having
been approved as to form by the City Attorney,
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COUNCIL
OF THE CITY OF MIAMI BEACH, that the Mayor and City Clerk-Finance
Director be and they are hereby authorized and directed to execute
said agreement in the name and on behalf of the City of Miami Beach.
