73-13865 RESOLUTION NO. 73-13865 WHEREAS, recent occurrences at the WOFFORD BEACH HOTEL in the City of Miami Beach involving dispossession of bona fide tenants by a mortgagee instituting foreclosure pro- ceedings on a defaulted mortgage has brought to the City Council of the City of Miami Beach, Florida, the gross in- equities of such situations whereby guests and tenants, not withstanding the payment of substantial sums of advanced rent for future occupancy are being threatened with summary evic- tion, and WHEREAS, the City of Miami Beach is without Charter authority or power to adopt remedial legislation designed to prevent such injustice, and that such legislation must emanate from the State level, NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, that the legisla- ture of the State of Florida at its forthcoming session to be held in April, 1973, immediately consider the enactment of appropriate legislation, including, but not limited to statu- tory requirements for constructive notice of the rights of such tenants and guests in actual possession so as to prevent the recurrences of such occurrences in the future, and BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, that copies of this Resolution be transmitted to the members of the Dade County Delegation to the State Legislature, and to the Speaker of the House, and the President of the Senate.
