RESOLUTION NO. 73-13882
WHEREAS, there was instituted and is now pending
in the United States District Court in and for the Southern
District of Florida a certain suit wherein SY LIPPMAN, MILTON
LEWIS, TEDDY E. KEDZIERSKI, HAROLD C. MANGELS, MAXWELL C.
HUNTER, GERALD S . WOLFF, and ROBERT SARNOW are Plaintiffs
and wherein ROCKY POMERANCE as Chief of Police of the City of
Miami Beach and individually, and CLIFFORD W. O 'KEY, then
City Manager of the City of Miami Beach and individually are
Defendants , and wherein said Plaintiffs claim and allege a
deprivation of civil rights arising out of their classifica-
tion as civilian employees in the Police Department of the
City of Miami Beach, and
WHEREAS, said cause has been set for trial in said
Court before a jury of twelve, commencing on January 29 , 1973,
and
WHEREAS, an offer of settlement has been made by
said Plaintiffs to settle said litigation by the payment by
the City of the sum of Ten Thousand Dollars ($10, 000. 00) in
full release of all claims by the Plaintiffs set forth in
said suit, except as to certain conditions the fulfillment of
which have been agreed upon by the said Chief of Police of
the City of Miami Beach and the present Acting City Manager
of the City of Miami Beach, and
WHEREAS, the City Attorney and Acting City Manager
have recommended to the City Council that the acceptance of
said settlement offer is in the best interest of the City of
Miami Beach and its inhabitants, and
WHEREAS, the City Council is familiar with the terms
and provisions of said settlement offer,
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY
COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, that the said
recommendations of the City Attorney and the Acting City Manager
be and they are hereby accepted and approved, and that the said
settlement offer be and the same is hereby accepted, and
BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MIAMI BEACH, FLORIDA, that the Mayor and the City Clerk and
Finance Director and the proper disbursing and financial officers
of the City be and they are hereby authorized and directed to
make the disbursement of Ten Thousand Dollars ($10, 000. 00) called
for by said settlement from funds of the City available for such
purposes on behalf of said City.
