Ordinance 499 i ORDINANCE NO. 499 AN ORDINANCE OF THE CITY OF MIAMI BEACH, FLORIDA, AMENDING SECTION ELEVEN OF ORDI.. NANCE NO. 496, BEING "AN ORDINANCE OF THE CITY OF MIAMI BEACH, FLORIDA, DEFINING THE AUTOMOBILE RENTING BUSINESS, IMPOSING A LICENSE TAX UPON THE BUSINESS OF RENTING AUTOMOBILES, PRESCRIBING AN APPLICATION FOR LICENSE TO ENGAGE IN SUCH BUSINESS, PRESCRIBING AN IDENTIFICATION TAG OR STICKER TO BE ATTACH- ED TO ALL AUTOMOBILES RENTED BY LICENSEES AND PRESCRIBING PENALTIES FOR CARRYING ON OR EN.. GAGING IN SUCH BUSINESS WITHOUT A LICENSE OR OTHER FAILURE TO COMPLY WITH THE PROVISIONS HEREOF AND REPEALING ORDINANCES IN CONFLICT HEREWITH", AND PROVIDING FOR THE CARRYING OF INSURANCE BY LICENSEES UNDER SAID ORDINANCE, AND OTHER MATTERS RELATING THERETO. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1: `Ibat Section Eleven of Ordinance No„ 496 be and the same is hereby amended to read as follows: "SECTION 11: No license shall be issued to any person, firm or corporation for the operation of an automo- bile renting business unless there has been issued to him by an insur- ance carrier authorized to do business in this State a public liability insurance policy or policies covering each such motor vehicle so rented in the amounts as hereinafter stated and insuring every person operat- ing such vehicle under a rental agreement or operating the vehicle with the express or implied permission of the owner against loss from the liability imposed by law upon such person arising out of the operation of said vehicle in the amount of $5,000. for bodily injury to or death of on'person and subject to said limit as respects bodily injury to or death of any one person, the amount of 410,000. on account of bodily injury to or death of more than one person in any one accident , and $5, 000. for damage to property of others in any one accident, The owner shall maintain such policy or policies in full force and effect during all times that he is engaged in the business of renting any motor vehicle without a driver. Said policy or policies need not cover any liability incurred by the renter of any vehicle to any passenger in such vehicle. The form and substance of said policy shall be subject to the approval of the City Attorney. Before any license shall be issued to any person, firm or corpor- ation, as provided in this ordinance, every such applicant shall first furnish to the City Clerk satisfactory evidence that the applicant has obtained the insurance hereby required, and that the same is in full force and effect and shall furnish to the City Clerk, as a part of the application required herein, the name of the insurance company with which said insurance has been effected and the amount of insurance carried. SECTION 2: All ordinances and parts of ordinances in conflict here» with are hereby repealed. PASSED AND ADOPTED this 20th day of Os ober, A. D. , 1937 , and that said ordinance remained posted for a period of at least thirty days in accordance with the require- ments of the City Charter of the said City of Miami Beach.
