ORDINANCE NO. 509
AN ORDINANCE REGULATING AND/OR
PROHIBITING THE PRODUCTION OR
EMISSION OF SMOKE OR SOOT WITHIN
THE CITY OF MIAMI BEACH, FLORIDA;
FIXING THE PENALTY FOR VIOLATION
THEREOF, AND OTHER MATTERS RELAT-
ING THERETO.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA:
SECTION 1: The production or emission within the City of Miami
Beach, of soot or smoke, the density or shade of
which is equal to or greater than Number Three (#3) of the Ringle-
mann Smoke Chart as published and used by the United States Bureau
of Mines, from any smokestack, chimney, engine or boiler, stove
or other machine, or othercontrivance, except private residence,
except for a period of time not to exceed six (6) minutes in any
one (1) hour, during which time the fire boxes are being cleaned
or a new fire being built therein, is hereby prohibited.
SECTION 2: Violation of this ordinance shall be punishable by a
fine of not more than Fifty ($50.00) Dollars, or im-
prisonment in the City Jail for not more than thirty (30) days,
or both, in the discretion of the Court.
SECTION 3: All ordinances and parts of ordinances in conflict
herewith are hereby repealed.

that Ordinance No. 509 entitled "AN ORDINANCE REGULATING
AND/OR PROHIBITING THE PRODUCTION OF SMOKE OR SOOT WITHIN
THE CITY OF MIAMI BEACH, FLORIDA; FIXING THE PENALTY FOR
VIOLATION THEREOF, AND OTHER MATTERS RELATING THERETO" ,
having been passed and adopted by the City Council of the
City of Miami Beach, Florida, has been posted by me in
three conspicuous places in the City of Miami Beach, one
of which was at the door of the City Hall in said City on
the 17th day of February, A. D. , 1938, and that said ord-
inance remained posted for a period of at least thirty days
in accordance with the requirements of the City Charter of
the said City of Miami Beach.
IN WITNESS WHEREOF I have hereunto set my
hand and affixed the official seal of the City of Miami
Beach, Florida, on this the 18th day of March, A. D. , 1938.
