Ordinance 367ORDINANCE NO. 367 AN ORDINANCE OF THE CITY COUNCIL OF THF CITY OF MIAMI BEACH, FLORIDA, GRANTING PERMISSION TO THE BUILDING INSPECTOR OF THE SAID CITY, WITH THE APPROVAL OF THE. COMMITTEEMAN ON BUILDINGS, THE FIRE CHIEF AND THE CITY MANAGER, TO EXERCISE HIS DIS- CRETION IN THE SUBSTITUTION OF MATERIALS AND/OR GRANTING PERMISSION FOR CHANGING REQUIR=ENTS OF THE BUILDING. CODE OF SAID CITY. WHEREAS, the Building Code of the City of Miami. Beach, Florida, was adopted on the 20th day of January, 1926; and WHEREAS, since said tine there has been great progress and development in the construction of buildings and the needs of newly developed businesses, making said. Code obsolete in many respects, a hardship upon builders and businesses whose needs and requirements are of a special nature; and WHEREAS, it is contemplated to rewrite said Building Code making same modern and un -to -date in every respect and suitable to the needs of modern builders and businesses, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, that SECTION 1. The Building Inspector of the City of Miami Beach, with the approval of the Committeeman on Buildings, the Fire Chief and the City Manager of the City of Miami Beach be and he is hereby permitted to exercise his discre- tion in the substitution of materials and/or granting permission for changing of requirements of said Code, in order that modern methods and materials may be used, and building operations in the City of Miami Beach may be carried on in accordance with efficient, suitable and modern practices. SECTION 2 written, This Ordinance shall be in effect only until such time as Ordinance No. 233, known as the Building Code of the City of Miami Beach, shall have been re - brought up to date, modernized and regularly adopted. SECTION WHEREAS, an emergency exists, this Ordinance is here- by declared to be an emergency measure on the ground of urgent public need for the preservation of peace, health, safety, welfare and property in the City of Miami Beach, and shall apply to all building operation now under construction and all buildings hereafter to be constructed, altered or repaired. SECTION 4. All Ordinances and parts of Ordinances in conflict herewith are hereby repealed. PASSED AND ADOPTED this 2nd dae f January, A. D., 1935. TOMLINSON, City Clerk in and for the City of Miami Beach, Florida, do hereby certify that Ordinance No. 367 entitled AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, GRANTING PER- MISSION TO THE BUILDING INSPECTOR OF THE SAID CITY, WITH THF APPROVAL OF THE COMMITTEEMAN ON BUILDINGS, THE FIRE CHIEF AND THE CITY MANAGER, TO EXERCISE HIS DISCRETION IN THE SUBSTITUTION OF MATERIALS AND/OR GRANTING PERMISSION FOR CHANGING REQUIREMENTS OF THE BUILDING CODE OF SAID CITY", having been duly passed and adopted by the City Council of the City of Miami Beach, Florida, has been posted by me in three conspicuous places in the City of Miami Beach, one of which was at the door of the City Hall in said City on the 16th day of January, 1935, and that said ordinance remained posted for a period of at least thirty days in accordance with the requirements of the City Charter of the said City of Miami Beach.
