WHEREAS, the City of Miami Beach is endeavoring to pro-
cure an appropriate alcoholic beverage license for the City of
Miami Beach Convention Hall Complex, and
WHEREAS, the State Beverage Commission, under its inter-
pretation of the law has determined that it may not issue such
license to the City of Miami Beach so long as an existing beer and
wine license is held by Oscar Markovich, the City' s concessionaire
for the Food and Beverage Commission for the said Convention Hall
Complex, and
WHEREAS, in view of the foregoing, the said Oscar Markovich
has agreed to waive his rights, as such licensee, and to subordinate
all his rights under his said license for the purpose of cooperating
with the City of Miami Beach in obtaining the issuance of the desired
alcoholic beverage license to the City of Miami Beach for the Con-
vention Hall Complex, provided however that all sales of alcoholic
beverages under such license issued to the City of Miami Beach shall
be subject to the provisions of said concessionaire ' s concession
contract with the City, and
WHEREAS, the City Attorney has advised the City Council
that the said concessionaire possesses such contractual right under
the express terms of the concessionaire ' s contract with the City,
and
WHEREAS, the City Attorney has advised the City Council
that an agreement setting forth the foregoing is proper and has
recommended that such agreement be entered into, and
WHEREAS, the City Council of the City of Miami Beach
deems it to be in the best interest of the City of Miami .Beach and
its citizens to enter into such agreement, the form thereof having
been approved by the City Attorney,
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COUNCIL
OF THE CITY OF MIAMI BEACH. FLORIDA, that the Mayor and the City
Clerk-Finance Director be and they are hereby authorized and directed
to execute said agreement for and in the name of the City.
