73-13990 RESOLUTION NO. 73-13990 WHEREAS, in July of 1971, one OLLIE W. SMITH, a City of Miami Beach employee, injured his right leg upon a piece of steel while loading a refuse trailer. This leg was subsequently reinjured in July of 1972, when the employee was struck in the same extremity by a metal cart, and WHEREAS, said employee was examined or treated by Drs. Grossman, Minervine and Rand, and WHEREAS, he suffered a permanent partial disability of his body as a whole, and WHEREAS, it is felt by the Legal Department that it is in the best interest of the City to enter into a settlement under the provisions of FSS 440.20(10) , as amended, 1967, such settlement to be in the amount of $6,220.00. $4,850.00 of this amount for the permanent partial disability to his body as a whole and all past, present or future compensation and medical benefits due Mr. Smith. A reasonable attorney's fee of $1,350.00, and $20.00 court reporter's fee for the balance, and WHEREAS, the Order of the Judge of Industrial Claims approving such settlement stipulation will not be subject to modification or review, and WHEREAS, the City Council deems it to be in the best interest of the City to enter into a final settlement stipulation as herein before set forth, NOW, THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, that the Legal Department be authorized to enter into final settlement stipulation with OLLIE W. SMITH and his attorney, and if said settlement is approved by a Judge of Industrial Claims, Ale Mayor, City Clerk-Finance Director and the City Attorney be, and theyre hereby authorized and directed to comply with the Order of the Judge approvi+tg'said stipulation.
