73-14004 RESOLUTION NO. 73-14004 Pursuant to the mandate of the electorate as reflected by the Special Election held in the City of Miami Beach on April 23, 1970, for the construction of a 200-unit Low-Rent Rousing Project for the Elderly under Turnkey Contractual Procedures authorized by the United States Housing Act of 1937, as amended, on the following described parcel of land; to wit: Lots 15 through 20, Block 111, OCEAN BEACH ADDITION NO. 3, Plat Book 2, page 81, of the Public Records of Dade County, Florida, and pursuant to the provisions of Chapter 422 , Florida Statutes, and other laws in addition and supplemental to the powers con- ferred and authority granted thereby to the City Council of the City of Miami Beach, Florida, authorizing and permitting the City Council to do any and all things necessary and convenient to aid or cooperate in the planning, undertaking, construction or operation of such housing project, NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, that the said Low-Rent Housing Project for the Elderly is a use specifically authorized, permitted, and directed upon the parcel of land hereinabove described under existing ordinances, including all existing zoning ordinances and building codes, and that the said Project shall be authorized for 200 living units, as contemplated under existing contractual agreements between Miami Beach Public Housing Authority and the United States of America, its Department of Housing and Urban Development, and E. D. A. , Inc. , a Florida corporation; and that no more than fifty (50) off-street parking spaces shall be required in connection with the construction of said 200-unit Low Rent Housing Project for the Elderly, it being understood and agreed that nothing herein contained shall in any way impair, defeat, or frustrate in any manner or degree whatsoever existing agreements for the preservation to the City of a 40-foot easement on the westerly 40 feet of said parcel of land for all proper and appropriate marina purposes, and BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, that pursuant to the provisions of the Charter of the City of Miami Beach, and of said Chapter 422, Florida Statutes, this resolution be adopted as an emergency measure and that the provisions hereof shall take effect immediately and forthwith.
