73-14008 . RESOLUTION NO. 73-14008 WHEREAS, on April 23, 1970, the Electorate of the City of Miami Beach authorized and approved the issuance of $4,000,000 Bond Issue for the purpose of constructing a Theatre of the Performing Arts, and WHEREAS, it is necessary for such construction that a qualified architect be retained for the purpose of drawing the requisite plans and specifications for such construction, and WHEREAS, the City Council of the City of Miami Beach has heretofore authorized and directed the City Manager to interview all qualified and interested architects for a determination of their suitability and availability to perform such services for the City of Miami Beach, and WHEREAS, following such inquiry and determination, City Manager has recommended the employment of MORRIS LAPIDUS with the agreement and understanding that said MORRIS LAPIDUS would be associated with RALPH ALSWANG - THEATRE PLANNING AND ASSOCIATES , in the rendition of said architectural services, and that an. appropriate agreement be entered into between the City of Miami Beach and said Architect at a fee of 10.5% of a budgeted cost of $3, 600, 000, with a maximum fee not to exceed $380,000, and WHEREAS, City Council of the City of Miami Beach, Florida, has considered the recommendation of the City Manager and has further considered the provisions of said employment agreement, said agreement having been duly approved as to form by the City Attorney, NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, that recommendation of the City Manager for the employment of MORRIS LAPIDUS in association with RALPH ALSWANG and the agreement, be and the same are hereby accepted and approved and said agreement, the terms and provisions thereof being familiar to the City Council, be and they are also hereby approved, and BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Clerk are hereby authorized to execute and deliver the same in the name of the City and the proper financial officers of the City of Miami Beach are hereby authorized and directed to make financial payments in accordance with said agreement.
