A RESOLUTION REQUESTING METROPOLITAN DADE COUNTY
TO ENFORCE VIGOROUSLY ALL APPLICABLE LAWS AND
REGULATIONS PERTAINING TO THE PREPARATION AND
HANDLING OF FOOD IN HOTELS AND RESTAURANTS .
WHEREAS, the function of policing and enforcing laws
and regulations pertaining to the preparation, handling and
serving of food and beverage in hotels and restaurants in the
City of Miami Beach has been pre-empted by Metropolitan Dade
County, in conjunction with the State of Florida Hotel and
Restaurant Commission, and
WHEREAS, by reason of such pre-emption of enforcement
activities by Metropolitan Dade County and the State of Florida,
the powers of the City of Miami Beach, Florida, in this regard
are virtually limited to the issuance of occupational licenses,
and
WHEREAS, City Council of the City of Miami Beach, Florida,
deems it of paramount interest and importance to its citizens,
residents and visitors that the laws and regulations pertaining
to the preparation, handling and serving of food and beverage in
hotels and restaurants be strictly enforced,
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COUNCIL
OF THE CITY OF MIAMI BEACH, FLORIDA, that Metropolitan Dade County,
and the Hotel and Restaurant Commission of the State of Florida,
be and they are hereby strongly urged and requested to rigidly
and vigorously enforce all applicable laws, rules and regulations
pertaining to the preparation, handling and serving of food and
beverage in hotels and restaurants and that no effort should be
spared in this regard so that the public may be assured that all
health and cleanliness measures are being fully complied with and
that the proper enforcement officials are sparing no effort in
instituting proper enforcement and prosecution measures to ensure
strict compliance with all laws, rules, and regulations pertaining
to the subject matter hereof,
BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MIAMI BEACH, FLORIDA, that copies of this resolution be trans-
mitted to the County Manager, members of the Metropolitan Dade
County Commission and to the appropriate executive officers of
the State of Florida. Hotel and Restaurant Commission forthwith.
