73-14042 RESOLUTION NO. 73-14042 WHEREAS, the City of Miami Beach, through its "Operation Re-Entry, " has been actively engaged in a program having for its objective the control and solution of the drug problem, particularly among children of school age, and WHEREAS, City of Miami Beach, in cooperation with the Dade County School Board, has actively furnished various services to the said School Board, and WHEREAS, Dade County School Board has agreed to reimburse City of Miami Beach in the amount of $1,000 for expenditures made by the City of Miami Beach in the conduct of said Operation Re-Entry for the period from June 18, 1973, through August 22, 1973, and WHEREAS, proposed agreement has been prepared by the City Manager and approved as to form by the City Attorney, providing that Dade County School Board shall pay to the City of Miami Beach $1, 000 upon completion of the program, and WHEREAS, the City Council deems it to be in the best interests of the City of Miami Beach and its residents and tax- payers that said Agreement be duly entered into, NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, that the Mayor and the Acting City Clerk be and they are hereby authorized to execute and deliver said agreement in the name and on behalf of the City of Miami Beach. '3 , , Mayor Attest: (Lrtcwk Acting City Clerk RESOLUTION NO. 73-14043 WHEREAS, on June 4, 1971 , one EUGENE 7_EMBRUSKI while working, slipped and fell against the side of his truck and then on to a curb, injuring his right ankle and lower back. WHEREAS, said employee was examined or treated by Drs. Grossman, Russell and Turke, and WHEREAS, he suffered a permanent partial disability of his body as a whole, and WHEREAS, it is felt by the City Attorney that it is in the best interest of the City to enter into a settlement under the provisions of FSS 440.20 (10) , as amended, 1967, such settlement to be in the amount of $1 ,663.50, $980.00 of this amount for the permanent partial disability to his body as a whole and all past, present or future compensation and medical benefits due Mr. Zembruski . A reasonable attorney's fee of $379.00 payment of $284.50 in Doctor's bills to George J. Turke, Jr. , M. D. , and Court Reporter's costs of $20.00, and WHEREAS, the Order of the Judge of Industrial Claims approving such settlement stipulation will not be subject to modification or reviews, set forth, NOW, THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, that the City Attorney be authorized to enter into final settlement stipulation with EUGENE ZEMBRUSKI and his attorney, and if said settlement is approved by a Judge of Industrial Claims, the Mayor, City Clerk, Finance Director and the City Attorney be, and they are hereby authorized and directed to comply with the Order of the Judge approving said stipulation.
