Ordinance 524 ORDINANCE NO. 524 AN ORDINANCE REGULATING THE CONSTRUCTION, INSTALLATION, OPERATION, MAINTENANCE, REPAIR, TESTING AND INSPECTION OF HOUSE PIPING, AP- PLIANCES AND OTHER EQUIPMENT IN CONNECTION WITH THE USE OF MANUFACTURED GAS, NATURAL GAS, OR GAS DERIVED FROM PETROLEUM PRODUCTS, IN THE CITY OF MIAMI BEACH, CREATING AND INVESTING CERTAIN DUTIES IN A BOARD OF EXAMINERS OF GAS FITTERS; PROVIDING FOR THE EXAMINATION, REGISTRA- TION AND REGULATION OF GAS FITTERS; PROVIDING FOR THE ISSUANCE OF PERMITS AND THE COLLECTION OF FEES; PROVIDING A PENALTY FOR THE VIOLATION OF THIS ORDINANCE AND REPEALING ALL LAWS AND PARTS OF LAWS IN CONFLICT HEREWITH; PROVIDING THAT IF ANY SECTION BE DECLARED UNCONSTITUTIONAL IT SHALL NOT AFFECT THE REMAINING SECTIONS; PRO- VIDING THAT THIS ORDINANCE SHALL BECOME EFFECTIVE IN THIRTY DAYS. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA: DEFINITIONS: SECTION 1: GAS FITTING. Gas fitting shall be deemed to mean the profession, art or trade of and all work done and all materials used in and for the installation of gas house-»piping and/or appliances. SECTION 2: MASTER PLUMBER„ A person who assumes responsible charge and direction of other persons in the installation of gas house-piping and/or appliances and holds a Master Gas Fitter's certificate issued within the current calendar year by the Board of Examiners of Plumbers of the City of Miami Beach, certifying his fitness to assume such responsibility► SECTION 3. JOURNEYMEN GAS FITTERS, A person who performs the manual work of installing gas house"piping and/or appliances under the direction of a Master Plumber and who holds a Journeyman Gas Fitter's certificate of the City of Miami Beach, certifying to his fitness to perform such manual work, SECTION 4 ; APPLIANCE. A device designed for the purpose of using manufactured gas, natural gas, or gas derived from petroleum products, supplied through house-piping for heat, light, refrigeration, power and other purposes, or an accessory attachment or device used with an appliance as a part thereof, SECTION 5. FLUE OR VENT. A pipe or enclosed passage for conveying gas and other products of combustion from an appliance to the chimney or outer air, SECTION 6: HOUSE-PIPING, All pipe and fittings from the outlet side of the Service Companyts meter and/or measuring device, bottle, can, or container, to the appliance or appliances, SECTION 74 OUTLET, The termination of any pipe or fitting for the purpose of supplying an appliance, SECTION g: LATERAL, A horizontal pipe supplying gas to or from the various risers, making up the house-piping, SECTION 9: RISER,, A vertical pipe supplying gas to or from the various laterals making up the house-piping, SECTION 10: TRAP. A low place in a horizontal pipe where liquids may collect, SECTION 11: SERVICE COMPANY. Any person, firm or corporation en- gaged in the manufacture and/or distribution of gas within the City limits of Miami Beach, either by pipe line, bottles, cans, or containers, SECTION 12: SERVICE PIPE. The pipe installed from the Service Companyts main, bottle, can or container, to the meter, SECTION 13: METER LOOP OR MANIFOLD. The pipe and fittings leading from end of Service Pipe to and including meter inlet connection or meter cock, SECTION 14: BURNER CAPACITY, In determining the gas consumption of an appliance, the rating as given by the American Gas Association Testing Laboratory shall apply, SECTION 15: APPROVED APPLIANCE. An appliance bearing the "approved seal" of the American Gas Association Testing Laboratory, or other Laboratory of equal standing. ARTICLE I GAS FITTERS CERTIFICATE SECTION 1. Any person, firm or corporation now operating or here- after desiring to engage in or work at the business of gas fitting, either as a Master Gas Fitter, or a Journeyman Gas Fitter, in the City of Miami Beach, shall make application to a Board of Examiners of Plumbers hereinafter provided for, at such time and place as said Board may direct, Said examination, may, at the option of the Examining Board, be made in whole or in part in ,''Ja writing, and shall be of a practical and elementary character, but sufficiently strict to test the qualifications of the applicant, SECTION 2. A Board of Examiners of Gas Fitters to consist of the City Board of Examiners of Plumbers is hereby established, SECTION 3. Each member of said Board of Examiners of Gas Fitters, attending, shall receive a fee of fifty cents for each applicant examined. Such fee to be paid out of the funds of the City of Miami Beach, The Plumbing Inspector shall be ex"+officio Chairman of said Board of Examiners. SECTION 4. Said Board shall, as soon as may be practicable, after their appointment, meet and then designate the times and places for examination of all applicants desiring to engage in or work at the business of gas fitting within the City of Miami Beach, Said Board shall examine said applicants as to their practicable knowledge of gas fitting and, if satisfied of the competence of such applicant, shall thereupon issue a certificate to such applicant, authorizing him to engage in or work at the business of gas fitting either as Master Gas Fitter or as Journeyman Gas Fitter, The fee of each exi amination, including certificate if issued, for a Master Gas Fitter shall be Ten Dollars ($1000) , and for a Journeyman Gas Fitter, it shall be Five Dollars ($5,00) , Said certificate shall be valid for the term of one (1) year, beginning with the fiscal year, but same can be renewed if application for renewal is made to said Board and a renewal fee of *1,00 paid for each year, All monies shall be paid to the City Clerk of the City of Miami Beach, for the use of said City. SECTION 5, No licensed Plumber shall allow his name to be used by any person or party, directly or indirectly, either for the purpose of obtaining a permit or to do any work under his license unless employed by him. SECTION 6. No Master Plumber shall send any person on any job (requiring license) in the capacity of a Gas Fitter, or shall any person execute any gas fitting work unless such person is in possession of a certificate issued in the current year by said Board. ARTICLE 2, PLUMBING INSPECTOR SECTION 1, When the words "Plumbing Inspector" are used, it means any person charged with the enforcement of the provisions of this Ordinance, under the direction of a Chief Plumbing Inspector, SECTION 2, The Plumbing Inspector shall have control and supervision of the methods and materials used in any part of gas in.' stallation and the issuance of certificate of Inspection, SECTION 3, The duties of the Plumbing Inspector shall be: (a) The examination and approval of plans and specifications of gas piping, appliances, and/or ventilation, (b) The issuance of permits* (c) The inspection of gas-piping, gas appliances or ventilation, (d) The conducting of tests. (e) May cause the prosecution of offenders of this code, (f) Advisory service to the public in matters of regulation, (g) The inspection of and condemnation of defective house-piping, ventilation and/or gas appliances, SECTION 4, The Plumbing Inspector is empowered and authorized to enter into or upon any public or private building or premises for the purpose of examining, inspecting and/or testing house-piping, appliances or ventilation within such building or premises at any time, INVESTIGATION OF COMPLAINTS SECTION 5, The Plumbing Inspector shall examine all premises, about which a complaint of the gas piping, ventilation or gas appliances is made, and he shall, upon evidence of the improper in- stallation, dangerous, or unfinished condition thereof, condemn same and notify the owner or agent of such premises to arrange the house- piping, ventilation or gas appliances thereof, according to the require- ments of this Ordinance, Such notices shall be made in writing or verbally, Any person or persons failing to place the piping, ventila- tion or gas appliances of such premises or building in proper condition, as instructed by the Plumbing Inspector within the time fixed by the Plumbing Inspector shall be subject to prosecution, APPROVAL OF PLANS SECTION 6. The Plumbing Inspector shall examine all plans and specifications filed in his office for his approval. Ike shall also issue and sign all notices, certificates and permits, RECORDS OF OFFICE SECTION 7A The Plumbing Inspector shall keep a record of all in- spections made, or complaints received and investigated, plans and specifications examined, notices served, permits issued, fees collected, applicants for certificates and all other services performed by his department, ALTICLE WORKING DRAWINGS SECTION 1. Master Plumbers shall file all plans and specifications and any other information required by this Ordinance, Such plans shall state the name and address of the owner, agent, tenant, Master Plumber, Journeyman Gas Fitter, and the location of the work. Permission shall be obtained from the Plumbing Inspector before any change or alteration is made from approved plans and specifications, Changes in installation shall be submitted for approval before such change is made, All changes shall be incorporated in a final plan and submitted for approval before final inspection is made, SECTION 2, Nothing herein contained shall prohibit any bona fide owner from personally installing gas piping and appliances on his premises or in his building, provided that said owner shall: (a) File plans and specifications with and have same approved by Plumbing Inspector,,, (b) Apply for and secure permit, (c) Pay required fee. (d) Do the work in accordance with this Ordinance, (e) Apply for Inspection, (f) Receive certificate of approval, (g) Personal installation by owner ( other than Master Plumber) shall be by himself, for himself, in his own building or premises, without compensation or pay from or to any other person for such labor or inspection, The Owner exercising this privilege shall conform to all requirements and be subject to the penalties of this Ordinance, The owner exercis- ing this privilege shall not set himself up as a c Master Fitter and in such installations the word "Owner" shall be substituted for the word "Gas Fitter", throughout this Ordinance. (h) Sign a notarized statement upon blanks furnished by the City of Miami Beach that the provisions herein contained will be observed. ARTICLE 4. INSPECTI©NS SECTION 1. (a) All gas piping, appliances and vents shall be inspected by the Plumbing Inspector to insure compliance with all requirements of this Ordinance, and installation and construction of the system in accordance with the approved plans and the permit. (b) Notice shall be given the PlumbingAit Inspectorts office, together with the number of the permit, when the work is ready for inspection. SECTION 2, The equipment, material, power and labor necessary for the inspection and tests shall be supplied by the Gas Fitter, SECTION 3. All installations of gas piping and vents shall be in- spected before any appliances are connected thereto, and the approval of the Inspector obtained before gas is turned into said gas piping. (a) The labor and materials necessary for inspections shall be supplied by the person or persons making the installations, (b) No person except employees of the Service Company shall have the right to cut into, tap, or otherwise disturb a pipe carrying unmetered gas except in an emergency such as fire, accidental damage to pipe, and like conditions, In such cases, the Service Company shall be immediately notified, (c) The Service Company shall build the meter loops or manifold up to meter inlet, and person doing the house-piping shall start house-piping at the meter outlet, in the manner and location designated by the Service Company. (d) All pipes of the gas system shall be tested with air pressure of 6" mercury column and maintained with no drop for a period of ten minutes, (e) In cases where connections are made to an existing gas pipe, and the developed length of the new work does not exceed twelve feet, and is entirely exposed, the air test may be omitted, but soap and water test must be applied, ( f) Under no conditions will any agent other than air be permitted in testing gas lines, except as noted in Paragraph "E", No air test shall be made while any physical connection exists between a pipe carryings and any piping or appliance being tested, After any extension, repair or replacement requiring an air test, or after leaving any gas pipe or appliance open to the atmosphere, said pipe or appliance shall be thoroughly purged with gas. (g) Whenever gas piping has been inspected and approved by a Plumbing Inspector, the Plumbing Inspector shall issue a certifi- cate of inspection. (h) No gas shall be turned on in any building until such certificate has been issued. TURN ON TEST: When turning gas under pressure into any pip- ing, the person in charge shall closely observe the hand on the test dial (a small dial generally above the regular dial on a meter) to ascertain whether there is any passage of gas through the meter, and if any is noted shall immediately shut off gas until cause of leak has been determined and remedied„ Section 4. No gas piping, or extension thereof, shall be covered or gas turned on until it has been inspected, tested and ap- proved by the Plumbing Inspector. Section 5. If any house piping, or extension or part thereof, is covered before being regularly inspected, tested and approved, it shall be uncovered upon the order of the Plumbing Inspector. Section 6. If any house-piping shows defects or a violation of this Ordinance, such defective work shall be replaced to conform to the requirements of this Ordinance within twenty-four hours (24) , and inspections and tests repeated. Section 7. After the satisfactory completion and final tests of the gas piping system, and upon request, a certificate of approval shall be issued by the Plumbing Inspector to the Gas Fitter, and a copy delivered to the Service Company. ARTI CLE 5 PERMITS AND FEES Section 1. Where permission is required by thiG Ordinance to install any gas house.-piping and/or gas appliances, same must be requested and granted in writing from the Plumbing Inspector before work can be started. Another permit for the same work shall not be issued until permit previously issued has been cancelled either by the Owner or the Gas Fitter, and the reason for cancellation given. Section 2. The fees for permits shall be as follows, charged for and collected by the Plumbing Inspectors (a) Gas permits (new work or remodeling) $1.00 for one outlet and 250 for each additional outlet, includ- ing connection of appliances. (b) A fee of $1.00 shall be paid for each inspection where a gas appliance is set on an old outlet, including less than 10 feet of piping. (c) A fee of $1.00 shall be charged by the Inspector for making such reinspection as may be due to the work being condemned or not being ready at the time speci- fied in the application for inspection. (d) When an incomplete or incorrect plan as regards owner- ship or location, or installation of a building is handed the Inspector of Plumbing, he shall charge a fee of $1.00 for making the correction or completion of the information. ARTICLE 6 SPECIFI CATIONS Section l All gas house-.piping shall be constructed and installed so as to be durable, substantial and gas tight. Piping shall be installed 7. aNimminmemew so as to prevent an accumulation of condensation which may interrupt the flow of gas and the building structure shall not be weakened by the installation of the piping. No flame or fire in any form shall be used in attempting to locate a gas leak. Section 2. All pipe shall conform to A. S. T. M. Standards for galvanized, wrought iron and/or steel. Pipe ised must be free from rust or scale, burrs or other ob- structions. Copper tube, where exposed, will be permitted for the connection of appliances between the outlet and the appliance, where the joints are of the flared type. Section 3.aiittings shall conform to A. S. T. M. Standards and wrought iron or steel fittings shall be gal- vanized, reducing fittings must be where a change of size of piping is necessary and no unions shall be used except the ground joint type, and then only wk re exposed. Bushings may be used only at meter connections. (b) All gas appliances, devices and/or acces- sories offered for sale or installed within the City of Miami Beach shall be "approved appliances". (c) Joints shall be made with white lead or equivalent and applied only on male threads. No "gas fitters cement" or like material shall be used, and a violation of this rule shall be sufficient cause for the Plumbing Inspector to refuse certificate or approval. Section 4. Approved stop valves and headers shall be provided for each meter and a separate stop valve for each governor. The Service Company shall provide both. Reductions in pipe size to appliance pipe size shall be made within twelve (12) inches of the appliance inlet. (c) No pipe shall be less in diameter than the size specified for that length. (d) If the exact size pipe figured cannot be found in the table, take the next largest size. (e) When, in remodeling old buildings or making additions thereto, it is impractical to comply strictly with these requirements, the Plumbing Inspector shall have the power to modify these provisions so that the spirit and substance thereof shall be complied with. Section 5• DRIPS. All piping shall grade (a) To the meter. (b) The drip pipe shall be installed in such a manner as to collect scale, dirt and condensation and shall be of easy access from the outside of the building where practicable. (c) The end of each house pipe at the meter outlet shall be provided with a drip consisting of a nipple and cap. (d) House piping drips shall be of the same diameter as the pipe served, and not less than 6" long. Where air or oxygen under pressure is used in con- nection with the gas supply, effective means shall be provided to prevent air or oxygen from going back into the gas piping. -10. Section 7. No water heating appliances shall be installed in a system of water piping unless a water relief valve is provided. Section 8. Appliances shall be installed so that their con- tinued operation will in no way create a fire hazard and are in con- formity with ordinances and rules of the Building Division and/or Fire Division of the City of Miami Beach. Section 9. No appliance shall be installed in a room in which the facilities for ventilation do not permit the proper cm. bustion of the gas, under normal conditions of use. Section 10. All gas piping shall be supported by approved hangars at intervals of not less than ten (10) feet. Pipe laid in ground shall be painted with red lead, tar or equivalent, and shall be properly tamped in place. Where passing through concrete or other masonry, it shall be wrapped in asbestos felt paper and tar. Section 11. (a) No meters shall be placed inside of kitchens , bathrooms, bedrooms, or living rooms of any residence or apartment house, or where people are sleeping. All meters must be placed on the outside of buildings or apartment houses or residences where suitable space is available. Where suitable space is not available outside the building, they may be placed inside a fire-.proof room and ventilated to the outside. Where regulators are placed within ten (10) feet of a door or window, except on buildings situated in dis- tricts zoned for residences, a relief pipe from the regulator shall be carried to the roof. (b) Pressure regulators or governors shall be installed on the service of all gas meters in localities designated as high pressure areas by the Service Company. Such regulators or governors shall not be installed inside a building. Section 12. The following appliances shall be suppliedwith suitable vents: All types of gas water heaters with burner capacity of 70 cubic feet per hour or more, except those installed in places where adequate ventilation in the opinion of the Plumbing Inspector, is assured at all times. No gas heater used or intended to be used for heating water shall be installed in any closet or compartment less than three (3) feet in its least dimension, unless such closet or compartment is of fire-proof construction. When non-fire-proof con- .11. struction is used, all sides of the enclosure including the inside surface of the floor, the floor, walls ard.ceiling thereof must be lined with asbestos paper of one-quarter (*) inch thickness. In every room or closet where such heater is installed, there shall be provided an air outlet and inlet independent of doors and windows, except that doors may be made Shorter. The area for such airways shall be one (1) square inch for each cubic foot of rated burner capacity, and the minimum area of such airways shall be thirty-six (36) square inches. The air inlet shall be near the floor and an equal space provided for products of combustion near the ceiling. Section 13„ Every gas water heater coming under the classifi- cation or conditions given below is required to be vented: (a) With burner capacity of 70 cubic feet per hour or more. (b) Automatic or instantaneous water heaters not provided with safety pilots when installed in rooms of less than 500 cubic feet, unless such rooms have permanent openings to other rooms, such as an archway without a door. No restrictions are placed on water heaters of any size when placed on back porches which are always open to the outside atmosphere. Section 14. VENTS. No vent pipe shall have a smaller cross- sectional area than the cross-sectional area of flue outlet collar as provided by the manufacturer of the appliance. All vents shall extend to the outside air and shall be of approved non-combustible and non- corroding material. Vents shall, unless this requirement be waived by the Plumbing Inspector, extend above the roof of the building and shall be hooded for protection against rain and down drafts. All vented ap- pliances shall be equipped with an approved down-draft diverter placed at the appliance. No appliance shall be connected to a vent closer than two (2) feet to the connections of any other appliance, nor shall any gas burning appliance be connected to any chimney, smoke-stack or vent to which is connected an appliance using any other fuel. Section 15. Meters owned by the Servide Company shall be and are at all times under their sole ownership and control, and the Ser- vice Company reserves the right to locate same on the consumer's proper- ty. None but duly authorized agents of the Service Company shall set or remove, turn on or off, or in any way interfere or tamper with such meters. Section 16. All installations of house-piping, appliances add other equipment served by or connected with the Service Company's dte., tributive system shall be installed and operated in accordance with the current rules and regulations of the Service Company (providing they are not inconsistent herewith) . Section 17. Service Company shall have the right to install and connect or disconnect and remove meters and their protective devices at theiroption without permit, after certificate of approval has been issued on the installations. ARTI CLE_Z GENERAL Section 1. It shall be unlawful for any person, firm or corpora- tion to use gas txxixx through any gas house-piping and/or appliance hereafter installed, or to install a gas meter in or on any building, structure or premises within the limits of the City of Miami Beach until the same shall have been inspected and approved by the City of Miami Beach Plumbing Inspector and a certificate of inspection, as herein pro- vided, shall have been issued therefor. Section 2. It shall be unlawful for any person, firm or corpora- tion to connect with the Service Company's distribution system, any house-piping and/or appliances. Section 3. It shall be unlawful for any person, firm or corpora- tion to hinder or interfere with the Plumbing Inspector in the discharge of his duties under this Ordinance. Section 4. Any person violating any of the provisions of this Ordinam a shall, upon conviction before the Municipal Court, be punished by a find of not less than Fifteen (15) Dollars nor more than Two Hundred or (200) Dollars,/by imprisonment not exceeding thirty (30) days or both, in the discretion of the Court, .13- Section 5. Any Ordinance or parts of any Ordinance in . consistent with, or conflicting with the provisions of this Ordinance shall be and the same are hereby repealed. Section 6. In the event that a section of this Ordinance shall be declared unconstitutional or void for any reason by any Court of competent jurisdiction, such decision in no way shall affect the validity of the remaining sections of this Ordinance unless such Court Order, or Decision, shall so direct.
