AN ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF MIAMI BEACH, FLORIDA,
AMENDING ORDINANCE NO. 289, AS
AMENDED, BEING THE ZONING ORDINANCE
OF SAID CITY, SO AS TO RENUMBER
ITEMS IN SECTION 6 BUT IN NO SENSE
TO CHANGE THE MEANING THEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA:
SECTION 1. That Section 6 of Ordinance No. 289, as amended,
be and the same is hereby amended so as to be con-
sistent with the arrangement of the other sections
dealing with "USE REGULATIONS" , and for this reason to delete
items now contained which are already covered by "Item (1) Any
use permitted in the BAAA Business District", and to read as
follows:
"In the "BAA" Business District no building or land
shall be used and no building shall be hereafter erected,
constructed, reconstructed or structurally altered which
is designed, arranged or intended to be occupied or used
for any purpose, unless otherwise provided for in this
ordinance, excepting for one or more of the following
uses:
1) Any use permitted in the "BAAA"Business District.
2 Barber shops.
4 Restaurants.
Lodge halls.
5 Telegraph stations.
(6 Photograph galleries.
7 Post Offices.
Theatres and motion picture houses.
9) Beauty parlors.
10) Music stores and radio stores.
(11) Bathing casinos.
(12) Hardware stores.
(13) Storage for motor cars on the second floor and
above, providing access for cars is had through
a public alley and not otherwise; only upon ap-
proval and permit by theCity Council of the City
of Miami Beach,
or other similar enterprises or businesses, which are not
more obnoxious or detrimental to the welfare of the particu-
lar community than the enterprises or businesses herein
enumerated. "
SECTION 2. All ordinances or parts of ordinances in conflict
herewith are hereby repealed.
SECTION 3, This ordinance shall take effect immediately after
its passage, approval and posting.

OF THE CITY OF MIAMI BEACH, FLORIDA, AMENDING ORDINANCE NO.
289 , AS AMENDED, BEING THE ZONING ORDINANCE OF SAID CITY, SO
AS TO RENUMBER ITEMS IN SECTION 6, BUT IN NO SENSE TO CHANGE
THE MEANING THEREOF" , having been passed and adopted by the
City Council of the City of Miami Beach, Florida, has been
posted by me in three conspicuous places in the City of Miami
Beach, one of which was at the door of the City Hall in said
City on the 3rd day of October, A. D. , 1938 , and that said
Ordinance remained posted for a period of at least thirty
days in accordance with the requirements of the City Charter
of the said City of Miami Beach.
