Ordinance 528 of ► ORDINANCE NO. 528 AN ORDINANCE OF THE CITY OF MIAMI BEACH, FLORIDA, AMENDING SECTION 8 OF ORDINANCE NO. 391 OF SAID CITY, PROHIBITING THE SALE OF INTOXICATING LIQUORS UNDER CERTAIN CONDITIONS AND IN CERTAIN LOCATIONS WITHIN SAID CITY, REPEALING ALL ORDINANCES IN CONFLICT THEREWITH AND DECLARING THAT AN EMERGENCY EXISTS NECES- SITATING THE PASSAGE OF SAID ORDINANCE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1: That Section 8 of Ordinance No. 391 as amended by Ordinance No. 420 of the City of Miami Beach, Florida, reading as follows: "No liquor or intoxicating beverages of any kind or nature including wines, liquors, porter, ale and beer, shall be sold at any gasoline filling station, nor in any motion picture theatre, nor in any room opening into directly or indirectly, or in connection with any motion picture theatre" be and the same is hereby amended to read as follows: "No liquor or intoxicating beverages of any kind or nature including wines, liquors, porter, ale and beer, shall be sold at any gasoline filling station, nor in any motion picture theatre, nor in any room opening into directly or indirectly, or in connection with any motion picture theatre, nor on property fronting on 41st Street in the City of Miami Beach, Florida, for consumption on the premises. " SECTION 2: All ordinances and parts of ordinances in conflict herewith are hereby repealed. SECTION 3: Whereas, an emergency exists, the health and welfare of said City being impaired, this ordinance shall be given three readings in one session and be in full force and effect from its adoption as above set forth. TOMLINSON, City Clerk in and for the City of Miami Beach, Florida, do hereby certify that Ordinance No. 528, entitled "AN ORDINANCE OF THE CITY OF MIAMI BEACH, FLORIDA, AMENDING SECTION 8 OF ORDINANCE NO. 391 OF SAID CITY, PROHIBITING THE SALE OF INTOXICATING LIQUORS UNDER CEFTAIN CONDITIONS AND IN CERTAIN LOCATIONS WITHIN SAID CITY, REPEALING ALL ORDINANCES IN CONFLICT THEREWITH AND DELCARING THAT AN EMERGENCY EXISTS NECESSI— TATING THE PASSAGE OF SAID ORDINANCE" , having been passed and adopted by the City Council of the City of Miami Beach, Florida, has been posted by me in three conspicuous places in the City of Miami Beach, one of which was at the door of the City Hall in said City on the 24th day of November, A.D. , 1938, and that saidordinance remained posted for a period of at least thirty days in accordance with the requirements of the City Charter of the said City of Miami Beach.
