82-17150 RESOLUTION NO. 82-17150 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH CALLING PUBLIC HEARINGS FOR THE PURPOSE OF CONSIDERING AMENDMENTS TO ORDINANCE NO. 1891,' THE CITY' S COMPREHENSIVE ZONING ORDINANCE RELATING TO CONDITIONS ON THE USE OF PROPERTY WITHIN THE REDEVELOPMENT AREA. WHEREAS, the MIAMI BEACH REDEVELOPMENT AGENCY has requested certain amendments to Section 22 of the City' s Zoning Ordinance as per the attached request. - NOW, THEREFORE, be it resolved by the City Commission of the City of Miami Beach that public hearings be and they are hereby called for the purpose of considering an ordinance ammending the City' s Zoning Ordinance in conformity with the request of the Redevelopment Agency, said hearings to be held on November 3, 1982, at 2:30 o' clock P.M. and November 17, 1982 at 2:30 o' clock P.M. in the Commission :Chambers. The City Clerk is directed to publish the required notice. PASSED and ADOPTED this 6th day of October 1982. Parki e %�►- City Manager ; i./.46,, SUBJECT: REQUEST OF R A EVELOPMENT AGENCY TO AMEND THE CITY'S ZONING ORDINANCE NO. 1891 TO EXTEND THE MORATORIUM Attached to this memorandum is a communication from Gideon Kellerman, Executive Director of the South Shore Redevelopment Agency. Mr. Kellerman is requesting on behalf of the Agency that the City Commission proceed to adopt a Resolution setting forth the two required public hearings before the City Commission in order to amend the Zoning Ordinance, Section 22-15, which section contains a moratorium on new construction in the Redevelopment Project Area. Simultaneously, Mr. Kellerman, on behalf of the Agency, has also requested the Director of Planning to place before the Planning Board at its October 26, 1982 meeting the same subject, in order that the Planning Board may also conduct the appropriate public hearing on the Zoning Ordinance amendment. It is important to note that the Planning Board currently adheres strictly to a policy of requiring that any applications for zoning amendments be submitted a minimum of thirty (30) days prior to the established regular meeting date. If it the desire of the City Commission to consider this zoning text amendment prior to the expiration date of the new construction moratorium (November 18, 1982), it will be necessary for the City Commission to take the following actions: 1. The City Commission should request the Planning Board to respectfully waive its thirty (30) day application deadline, and to proceed to schedule the necessary public hearing; 2. The City Commission must adopt the attached resolution calling for (in advance) the necessary two (2) public hearings required by State law in order to adopt a Zoning Ordinance amendment. The Redevelopment Agency therefore requests that the City enact an amendment to said section which extends said period until March 31, 1983. - We request that the Planning Board take the matter -up at its meeting in the end of October and that the matter be • placed on the City Commission Agenda for first reading at_ ' . the first meeting in November of 1982 and for a second reading at the second City Commiss of n meeting in—ovember.
