A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF MIAMI BEACH AUTHORIZING THE CITY TO ENTER INTO
AN AGREEMENT WITH ISLAND DEVELOPER LTD. PERiMITTING
THE USE OF A PORTION OF FISHER ISLAND AS A TRAINING
FACILITY FOR THE MIAMI BEACH POLICE DEPARTMENT.
WHEREAS, the City of Miami Beach Police Department re-
quires the use of certain land, comprising 160 acres and the im-
provements thereon, located on Fisher Island, Miami Beach,
Florida for training purposes; and
WHEREAS, the above-mentioned "OWNER" of such property
agrees to allow the "CITY" to use its property for aforesaid
purpose without compensation or consideration of any kind for such
use; and
WHEREAS, the "CITY" shall save and hold the "OWNER" harm-
less from all claims, law suits or actions of any kind against
the "OWNER" resulting from the "CITY' S" use for the purposes afore-
said; and
WHEREAS, the "CITY" shall indemnify the "OWNER" for any
damage sustained by the subject property as a result of the use of
said property by the "CITY" during the duration of this Agreement;
and
WHEREAS, the "OWNER" shall obtain (3) appraisals estimating
such damage and the "CITY" shall pay to the "OWNER" the sum stated
based on the lowest of said (3) three appraisals; and
WHEREAS, this Agreement shall be in effect for an indefi-
nite period of time, however, it may be terminated at any time by
either party upon (3) three days' written notice to other party by
the party so terminating.
NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COMMISSION
OF THE CITY OF MIAMI BEACH authorizes the City to enter into an
agreement with Island Developer Ltd. permitting the use of Fisher
Island as a training facility for the Miami Beach Police Depart-
ment.
