A RESOLUTION RECOGNIZING THE NEEDS OF RESI-
DENTS LIVING IN THE CONDEMNED AREA SELECTED
AS THE SITE FOR THE CITY OF MIAMI BEACH PO-
LICE AND COURTS FACILITY; PROVIDING FOR POS-
SIBLE COMPENSATION TO SUCH RESIDENTS, BASED
ON THEIR PROPERTY INTERESTS; PROVIDING FOR
CITY-FUNDED RELOCATION COSTS TO LOW INCOME
RESIDENTS; PROVIDING FOR UTILIZATION OF COM-
MUNITY DEVELOPMENT RELOCATION POLICY GUIDE-
LINES WHERE APPLICABLE.
WHEREAS, the construction of the Miami Beach police
and courts facility is a public project which has necessitated
the relocation of certain elderly residents currently living in
the area approved for site selection; and
WHEREAS, the residents are primarily low-income; and
WHEREAS, many such residents are entitled to compensa-
tion based on the length and amount of their current leases; and
WHEREAS, it is the intention of the City of Miami
Beach to fully compensate all those persons entitled to compen-
sation under the law; and
WHEREAS, such compensation shall be paid regardless of
whether the tenants have moved prior to acquisition; and
WHEREAS, the City of Miami Beach desires to pay relo-
cation expenses to these qualified low-income residents in need
of such relocation assistance;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA that:
1. All of the above recitals are true and correct;
2. The City Commission directs the City Manager and
the City Attorney to exhaust every possible source of funding to
assist in the relocation of low-income needy tenants, including
but not limited to utilization of Community Development funds,
proceeds from the general obligation bonds for this project, and
other City revenues. Furthermore, the guidelines adopted by the
Community Development Relocation Policy shall be utilized by the
City Manager and the City Attorney as a method of approaching
this problem.
