A RESOLUTION AUTHORIZING ACQUISITION OF LOTS 1
AND 12, LOTS 3 AND 4 , AND LOT 5 , BLOCK 37 , OCEAN
BEACH ADDITION NO. 3 , AS RECORDED IN THE PUBLIC
RECORDS OF DADE COUNTY, FLORIDA, IN PLAT BOOK 2 ,
AT PAGE 81 , FOR $550, 850. 00, $410 , 000 . 00 AND
$410, 000. 00 RESPECTIVELY, INCLUDING ATTORNEYS '
FEES AND COSTS, BY PURCHASE AND THE FILING OF
EMINENT DOMAIN PROCEEDINGS AND DECLARATION OF
TAKING, AS NECESSARY.
WHEREAS , in Resolution 83-17326 , the City Commission of
the City of Miami Beach approved the site selection for the City
of Miami Beach police and courts facility, which included Lots 1
and 12, Lots 3 and 4 , and Lot 5, Block 37 , Ocean Beach Addition
No. 3 , as recorded in the Public Records of Dade County, Florida,
in Plat Book 2 at Page 81; and
WHEREAS, in the aforementioned resolution, the City
Manager and the City Attorney, through their staffs and through
special counsel were authorized by the City Commission to acquire
said lots by purchase, donation, or through eminent domain
proceedings, including declaration of taking; and
WHEREAS, the City Manager has negotiated the purchase
price of $550, 850. 00 for Lots 1 and 12 , $410 , 000 . 00 for Lots 3
and 4 , and $410, 000. 00 for Lot 5, including attorneys ' fees and
costs,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF MIAMI BEACH, THAT:
1 . This City Commission finds , determines and declares
that the matters set out in the foregoing recitals are true and
correct, and they are hereby incorporated as a part of this
Resolution.
2 . The recommendation of the City Manager as to the
purchase price of $550, 850. 00 for Lots 1 and 12 , $410 , 000 . 00 for
Lots 3 and 4 , and $410, 000. 00 for Lot 5, including attorneys '
fees and costs, is hereby accepted and approved.
3 . The City Commission authorizes the acquisition of
the above-described properties for the dollar amounts stated
above through purchase and the filing of eminent domain proceed-
ings, including declaration of taking, as necessary.
