99-23146 RESO RESOLUTION NO. 99-23146 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA CREATING AND ESTABLISHING A CODE ENFORCEMENT T ASK FORCE; PRESCRIBING ITS DUTIES AND PROVIDING FOR THE MANNER OF ITS APPOINTMENT AND TERMS OF OFFICE OF ITS MEMBERS. WHEREAS, the Mayor and City Commission believe that portions of the City's laws with regard to Code Enforcement may be outdated, ambiguous, in conflict with state and/or federal law or otherwise in need of revision in order to meet current and future needs of the citizens of the City; and WHEREAS, the Mayor and City Commission believe that review and revision of the City's laws pertaining to code enforcement, the special master process, settlement of fines and the establishment of priorities for enforcement is important to the welfare of the citizens of the City of Miami Beach; and WHEREAS, the Mayor and City Commission believe that review and revision of the City's laws pertaining to code enforcement can best be accomplished by creation and appointment of a City of Miami Beach Code Enforcement Task Force Board as set forth hereinbelow. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that a City of Miami Beach Code Enforcement Task Force Board be and the same is hereby created, and be it further resolved as follows: 1. Said Board shall consist of nine members, seven of whom shall be direct appointments, one made by the Mayor and each City Commissioner, which appointments shall be made on the basis of experience in the fields of law, zoning, City Code, South Florida Building Code, Fire Code, Americans with Disabilities Act, and general code enforcement and procedures relating thereto. The remaining two members shall consist of a representative designated by the City Manager and a representative designated by the City Attorney; both representatives shall be non-voting ex officio members. 2. Prior to selection for membership on this Task Force, each applicant shall complete and file an application form to be supplied by the City Clerk indicating his/her qualifications for appointment and identifying any real property in the City of Miami Beach owned by the applicant. Each applicant shall also, where applicable, submit his/her professional license or current registration; additionally, where applicable, applicants shall supply a copy of the occupational license for the location from which he/she practices that occupation. 3. The members of this Board shall begin serving within 5 days from final selection of Board membership. The Board shall submit written interim reports to the City Commission as may be requested by the Commission; the Board's final report shall be submitted by it to the City Commission on or before six months from the date of the Board's first meeting. 4. Members of this Board shall serve without compensation. The City Manager shall provide such Administrative staff and clerical personnel as may be necessary to assist the Board in the proper performance of its duties and functions. All expenses of the Board (including the provision of experts presentations) shall be assumed by the City of Miami Beach. The City Attorney's Office shall serve as legal counsel to the Board. 5. The members of the Board shall select and designate from its members a chairman and such other officers as may be deemed necessary, who shall serve at the pleasure of the Board. All meetings ofthe Board shall be open to the public and advertised. No action shall be taken by the Board except by a majority vote ofthe entire membership. 6. The Task Force shall be empowered to examine and evaluate any City Code provisions for which violation of same are prosecuted before the City's Special Master, and to identify those provisions which are in need of revision or elimination and to recommend amendments, changes and priorities in the enforcement of said provisions; the Task Force shall also look at and recommend procedures for settlement, mitigation and elimination of existing fines or liens which have been imposed through the Special Master process. In so doing, the Board, through its recommendations, shall strive to update the City's Code Enforcement laws, to make them effective, current and inclusive of any and all changes deemed necessary to comply with county, state, and federal law, to delete inapplicable provisions, to clarify ambiguities, and to add or revise provisions when necessary to meet current and future needs of the City. Pursuant to the request of City Commissioner Jose Smith made at the City Commission's meeting of April 14, 1999, the attached resolution has been drafted creating a City of Miami Beach Code Enforcement Task Force Board, whose primary function will be to review all applicable laws pertaining to City building and code enforcement and to revise same, when needed, in order to meet the needs of the citizens of the City of Miami Beach.
