AN ORDINANCE OF THE CITY OF MIAMI BEACH,
FLORIDA, AMENDING ORDINANCE NO, 394, BEING
"AN ORDINANCE OF THE CITY OF MIAMI BEACH,
FLORIDA, IMPOSING LICENSES AND OTHER TAXES
ON PRIVILEGES, BUSINESSES, OCCUPATIONS AND
PROFESSIONS CARRIED ON AND ENGAGED IN WITHIN
SAID CITY, AND PRESCRIBING PENALTIES FOR THE
EXERCISING OF SUCH PRIVILEGES OR CARRYING
ON SUCH BUSINESSES, OCCUPATIONS OR PROFESSIONS,
WITHOUT A LICENSE, OR OTHER FAILURE TO COMPLY
WITH THE PROVISIONS THEREOF",
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA:
SECTION 1, That Section 5 of Ordinance No. 394 be and the same is
hereby amended, under the caption or title "AMUSEMENT
AND RECREATION , by inserting after the item "Music or
Picture Taking Machines, each Machine #25.00", and
before the item "Natatoriums or Bathing Business *25.00",
the following item, to..wit:
"MUSIC, furnished by telephone wire
(Covering ten locations) $ 250.00
Each additional location 10.00"
SECTION 2. That Section 5 of Ordinance No. 394, be and the same is
hereby amended under the caption or title "AMUSEMENT
AND RECREATION", by rescinding the following item, to«.
wit:
"BOWLING ALLEYS, or Box Ball Alleys, per alley $ 5.00"
and substituting therefore, the following item, to«wit:
"BOWLING ALLEYS, or box ball alleys, per alley $10.00"
SECTION 3. That Section 5 of Ordinance No. 394, be and the same is
hereby amended under the caption or title "AMUSEMENT
AND RF►CREATION", by rescinding the following item, to-
wit:
"FORTUNE TELLERS, Palmists, Hypnotists, Clairvoyants,
Astrologers, Phrenologists, Physiognomists, Numerologists,
Mind Readers, and others of a similar nature, whether or
not in connection with another business, each *100.00"
and substituting therefore, the following item, to..wit:
"FORTUNE TELLERS, Palmists, Hypnotists, Clairvoyants,
Astrologers, Phrenologists, Physiognomists, Numerologists,
Mind Readers, and others of a similar nature, whether or
not in connection with another business, each $100.00"
Provided, that before license is issued to any person or persons,
pursuant to the foregoing item, a report must be made by the
Police Department to the effect that the applicant or applicants
have no record of conviction in any case involving a felony,
and the application must be accompanied by three or more character
references,"
SECTION 4., That Section 5 of Ordinance No. 394, be and the same is
hereby amended, under the caption or title "LIVING
ACCOMMODATIONS", by rescinding the following item, to..wit:
"APARTMENTS, APARTMENT HOUSES OR HOTELS, OR
ROOMING HOUSES, containing over 2 (two) bed..
rooms, for each room which can be leased,
not including bathrooms or kitchens . . . . . . . .50
Providing that each such apartment house,
etc. shall pay a minimum fee of . . . . . .10,00"
and substituting therefore, the following, to.wit:
"APARTMENTS, APARTMENT HOUSES OR HOTELS, con-»
taining over 2 ( two) bedrooms, for each
room which can be leased, not including
bathrooms, or kitchens . . . . . . . . . . . . . .50
Providing that each such apartment house,
etc. shall pay a minimum fee of . . . . . 10.00
ROOMING HOUSES, OR LODGING HOUSES in which
there are more than three beds for the use
of occupants, lodgers, roomers or boarders,
or in which more than six persons in said.
lodging house or rooming house are allowed
to sleep, shall pay a minimum fee of . . . . . 25.00"
SECTION 5. That Section 5 of Ordinance No. 394, be and the same
is hereby amended under the caption or title
"MERCHANTS, STOREKEEPERS AND DEALERS", by res-
cinding the following item, to.wit:
"FUEL..OIL, COAL, COKE, BOTTLED GAS, etc.,
dealers . 410 . . . . . • . . . . . . . . . . +/0,,,+o
and substituting therefore the following item, to.wit:
"FUEL DEALERS (excepting fire wood)
Fuel.oil, Coal, Coke, etc., dealers . . . 50.00
Bottled Gas, dealers • . . . . . . . . . . 25.00
(Provided that bottled gas dealers
also selling ranges and appliances
shall pay an additional license fee of 50.00"
SECTION 6, That Section 5 of Ordinance No. 394, be and the
same is hereby amended under the caption or
title "SERVICE ESTABLISHMENTS AND STATIONS",
by rescinding the following item, to.wit:
"BARBER SHOPS, with or without manicurist and/or
Boot.Black Stands, per chair . . . . . . . . . 5.00
(Provided that each shop shall pay a
minimum of $15.00) "
and substituting therefore the following item, to.wit:
"BARBER SHOPS, with or without manicurist and/or
Boot.»Black Stands, each shop . . . . . . . . 25.00"
SECTION 7, That Section 5 of Ordinance No. 394, be and the same
is hereby amended under the maption or title,
"SERVICE ESTABLISHMENTS AND STATIONS", by res-
cinding the following item, to.wit:
"BEAUTY PARLORS, hairdressing and manicuring,
per operator , , , , , , , , , , , , , , , , , 5.00
(Provided that eachsuch parlor shall pay a
minimum of 415.00) "
and substituting therefore the following item, to.wit:
"BEAUTY PARLORS, hairdressing, facial massage,
manicuring, etc., each shop . . . . . . . . . 25.00"
SECTION S. That Section 5 of Ordinance No. 391-, be
and the same is hereby amended under the
caption or title "SERVICE ESTABLISHMENTS
AND STATIONS , by rescinding the following
item, to..wi t:
"BICYCLES, Rent and Repair . . . . . • • • . $ 1500"
and substituting therefore, the following item:
"BICYCLES, Rent and Repair • . . . . . . . $ 25.00"
SECTION 9. That Section 5 of Ordinance No, 394, be and
the same is hereby amended under the caption

by rescinding the following item, to••wit:

and substituting therefore, the following item:

SECTION 12. That Section 5 of Ordinance No, 394, be and
the same is hereby amended under the caption
or title "SERVICE ESTABLISHMENTS AND STATIONS",
by rescinding the following item, to-.wit:

and substituting therefore, the following item:
"TAILOR, each shop . . • . . . . • . . . . $ 25.00"
SECTION 13. That Section 5 of Ordinance No. 394, be and the
same is hereby amended, under the caption or
title "MISCELLANEOUS", by rescinding the follow»
ing item, to-.wit:
"EXTERMINATORS . (insect and vermin) . . . $ 10.00"
and substituting therefore, the following item:
"EXTERMINATORS . (insect and vermin) . . . $ 25.00"
SECTION 14. That Section 5 of Ordinance No. 394, be and the same
is hereby amended, under the caption or title "MISCEL—
LANEOUS", by inserting after item "FORTUNE TELLERS,
Palmists, Hypnotists, ''lairvoyants, Astrologers,
Phrenologists, Physiognomists, Numerologists, Mind
Readers, and others of a similar nature, whether or
not in connection with another business, each . . *100.00"
and before the item "FUNERAL DIRECTORS AND UNDERTAKERS,
$50.00, the following item, to—wit:
"FRUIT SHIPPING, Whether operated in connection with
any other business, or not $ 25.00"
SECTION 15. That Section 5 of Ordinance No. 394, be and the same
is hereby amended, under the caption or title "MISCEL.
LANEOUS, by eliminating the following item:
"FORTUNE TELLERS, Palmists, Hypnotists, Clairvo.
yants, Astrologers, Phrenologists, Physiognomists,
Numerologists, Mind Readers, and others of a simi—
lar nature, whether or not in connection with
another business, each $100.00"
SECTION 16. All ordinances or parts of ordinances in conflict here—
with be and the same are hereby repealed.

OCCUPATIONS AND PROFESSIONS CARRIED ONAND ENGAGED IN WITH-
IN SAID CITY, AND PRESCRIBING PENALTIES FOR THE EXERCIS-
ING OF SUCH PRIVILEGES OR CARRYING ON SUCH BUSINESES,
OCCUPATIONS OR PROFESSIONS, WITHOUT A LICENSE, OR OTHER
FAILURE TO COMPLY WITH THE PROVISIONS THEREOF", having
been passed and adopted by the City Council of the City
of Miami Beach, Florida, has been posted by me in three
conspicuous places in the City of Miami Beach, one of
which was at the door of the City Hall in said City on
the 6th day of November, A. D. , 1940, and that said or-
dinance remained posted for a period of at least thirty
days in accordance with the requirements of the City Charter
of the said City of Miami Beach.
