Ordinance 584 ORDINANCE NO. 5g4 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA,AMENDING ORDINANCE NO. 2g9, BEING THE ZONING ORDI6 NANCE OF MIAMI BEACH, FLORIDA, SO AS TO ALLOW THE CONSTRUCTION OF DOCKS, WHARVES OR DOLPHINS OR SIMILAR STRUCTURES EXTEND. ING INTO BISCAYNE BAY FROM ANY PROPERTY FRONTING ON SAID BISCAYNE BAY, WHICH IS CLASSIFIED AS TO USE UNDER BUSINESS OR MULTIPLE-FAMILY DISTRICT, A DISTANCE OF NOT GREATER THAN 125 FEET, PROVIDED SPE» CIAL PERMISSION FOR SAID CONSTRUCTION IS OBTAINED FROM THE CITY COUNCIL. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1: That Paragraph C, under item 1 of Section 17, entitled General Provisions, be and the same is hereby amended to read as follows: "c. No dock, wharf, dolphin or structure of any kind shall be erected, constructed or reconstructed, so as to extend into Biscayne Bay a distance greater than twenty..five (25) feet , or so as to extend into Indian Creek, a distance greater than fifteen (15) feet or so as to extend into ¢ollins Canal a distance greater than three (3) feet, or so as to extend into any other waterway in the City of miami Beach, a distance greater than five (5) feet, except that with special permission of the City Council, docks, wharves, dolphins or similar structures may extend from a business or multiple-family lot into Biscayne Bay a distance not greater than one hundred twenty-- five (125) feet. No part of any such dock, wharf, dolphin or structure shall be higher than two (2) feet above the top of the adjoining seawall or the established grade for the seawall if none exists. SECTION 2: All ordinances and parts of ordinances in conflict herewith are hereby repealed. SECTION 3: This ordinance shall take effect immediately after its passage and posting. D. , 1940 and that said ordinance remained posted for a period of at least thirty days in accordance with the requirements of the City Charter of the said City of Miami Beach.
