Ordinance 592 • ORDINANCE NO. 592 AN ORDINANCE OF THE CITY OF MIAMI BEACH, FLORIDA, REGULATING THE EREC- TION, CONSTRUCTION, ENLARGING, ALTERA- TION, RT'AIR, MOVING, REMOVAL, DEMOLI- TION, CONVERSION, OCCUPANCY, EQUIPMENT, USE, HEIGHT, AREA AND MAINTENANCE OF ALL BUILDINGS AND/OR STRUCTURES IN THE CITY OF MIAMI BEACH, FLORIDA, AND OTHER MATTERS RELATING THERETO; PROVIDING FOR THE APPOINTMENT OF A BOARD OF RULES AND APPEALS TO OVERSEE LICENSE EXAMINATIONS CONNECTED WITH BUILDING ACTIVITIES, AND TO SUSPEND OR REVOKE SUCH LICENSES; ESTABLISHING FIRE ZONES; PROVIDING FOR PENALTIES FOR VIOLATIONS OF THIS ORDI- NANCE; AND REPEALING ORDINANCE NO. 233 AND ALL OTHER ORDINANCES OR PARTS OF OR- DINANCES IN CONFLICT HEREWITH. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA: Section 1. That the following document which comprises Section 2 of this Ordinance, being marked and designated as the °MIAMI BEACH BUILDING CODE", be and the same is hereby adopted as the building code of the City of Miami Beach, Florida, for the purpose of regulating the erection, construction, alteration, re- pair, moving, removal, demolition, conversion, occupancy, equip- ment, use, height, area and maintenance of all buildgs and/or structures in the City of Miami Beach, Florida, and other matters relating thereto. Section 3. That any person, firm or corporation violating azar of the provisions of the MIAMI BEACH BUILDING CODE as referred to and being a part of this Ordinance shall be deemed to be guilty of a misdemeanor and each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of the MIAMI BEACH BUILDING CODE is committed, continued or permitted, and upon conviction of any such violation or violations, such per- son shall be punishable by a fine of not more than $500.00, or by imprisonment in the city jail for not more than six months, or by both such fine and imprisonment. Section L . That Ordinance No. 233, and all other ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 5. That should any part of this Ordinance be declared to be unconstitutional or invalid, the remaining portions shall continue to have the same force and effect as though such un- constitutional or invalid portions had not been included. No wall, structure, building or part thereof, shall hereafter . be built or constructed nor shall the plumbing or wiring of any building, structure or premises be installed or altered, except in conformity with the provisions of this ordinance. Sec. 2. No building already erected, or hereafter to be erected, shall be razed, altered, moved or built upon, in any manger that would be in violation of any of the provisions of this ordinance, or the approval issued thereunder. Sec. 3. Before the demolition or removal of any building or structure is begun, a verified application shall be prepared by the owner, architect, builder or contractor, on appropriate blanks furnished by the Building Inspector, containing a statement of the facts in relation thereto, as to the ownership and location thereof. The application shall be filed with the Building Inspector and a written permit obtained from him, as hereinbefore provided. Sec. 4. When any building or structure, over 25 feet in height, is being erected, repaired or demolished, upon or along any sidewalk, the person erecting, altering or demolishing such building shall erect and maintain an approved and substantial shed from the property line to the curb for the full frontage of the building. No shed shall be required when a building is erected 8 feet or more back of sidewalk line. The street side shall be kept open for a height of not less than 7 feet above curb and shed shall be kept properly lighted at night. Sec. 5. Ordinary repairs on buildings or structures, the cost of which shall not exceed $100.00, may be made without notice to the Building Inspector. i . ARTICLE 2. Any reference in this Building Code to "building official" is hereby changed to "Director of the Dade County Zoning and Building Department" and any reference in this Code to "ap- pointing authority" or "legislative authority" is hereby changed to "Board of County Commissioners." Section 3. If any section, subsection, sentence, clause, provi- sion, or part of this ordinance, including the Exhibit attached hereto and made a part hereof, shall be held invalid for any reason, the re- mainder of this ordinance shall not be affected thereby but shall re- main in full force and effect. Section 4. All county and municipal ordinances, county and municipal resolutions, municipal charters, special laws applying to this county and general laws applying only to this county or any general law which this commission is specifically authorized by the Constitution to supersede, nullify or amend, or any part of any such ordinance, resolution, charter or law in conflict with any provision contained herein are hereby repealed.
