ORDINANCE NO, 611
AN ORDINANCE OF THE CITY OF MIAMI
BEACH, FLORIDA, AMENDING SECTION 5
OF ORDINANCE NO. 394 IMPOSING LICENSES
AND OTHER TAXES ON PRIVILEGES, BUSINESSES
AND OCCUPATIONS BY CHANGING THE LICENSES
AND TAXES IMPOSED ON CERTAIN BUSINESSES
SET FORTH AND DESCRIBED IN SAID SECTION 5
AND ADDING TO SAID SECTION 5 CERTAIN
ENUMERATED BUSINESSES AND IMPOSING LICENSES
THEREON,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA:
Section 1. That that portion of Section 5 of Ordinance No. 394 of the
City of Miami Beach, reading as follows, to-wit:
"APARTMENTS, APARTMENT HOUSES OR HOTELS containing
over 2 (two) bedrooms, for each room which can be
leased, not including bathrooms or kitchens . . . 505i
Providing that each such apartment house,
etc., s hall pay a minimum fee of . . . . . . . . $ 10.00"
be and the same is hereby amended so as to read as follows:
"APARTMENTS, APARTMENT HOUSES OR HOTELS containing
over 15 (fifteen) bedrooms, for each room which
can be leased or rented, not including bathrooms
or kitchens . . . . . 75O
Providing that each such apartment house or
hotel containing over 2 (two) bedrooms shall pay
a minimum fee of $ 10.00"
Section 2. That that portion of Section 5 of Ordinance No. 394
of the City of Miami Beach, reading as follows, to-wit:
"PRIVATE SCHOOLS for each place of business - - . 4 25.00
(Schools, colleges or other educational
or training institutions operated for
profit)"
be and the same is hereby amended so as to read as follows:
"PRIVATE SCHOOLS, for each place of business . . . $ 35.00
(Schools, colleges or other educational
or training institutions operated for
profit)"
Section 3. That that portion of Section 5 of Ordinance No. 394
of the City of Miami Beach, reading as follows,
to-wit:
"RESTAURANTS, DRUG STORES OR OTHER ESTABLISHMENTS
serving food (permitting the operation of cafe,
cafeteria, public dining-room, tea-room or
restaurant) with chairs or stools, each to count
as one seat, per seat . . 50¢
Providing that each such restaurant or
establishment serving food shall pay a minimum
fee of . . • • • . • • • . . . . . . . . . . . . $ 25.00"
be and the same is hereby amended so as to read as follows:
"RESTAURANTS, DRUG STORES OR OTHER ESTABLISH-
MENTS serving food (permitting the operation
of cafe, cafeteria, public dining room, tea-
room or restaurant) with chairs or stools,
each to count as one seat, per seat . . . . . 75¢
Provided that each such restaurant, drug
store or establishment serving food shall pay
a minimum fee of . . . . . . . . . . . . . . $ 25.00"

394 of the City of Miami Beach, reading as
follows, to-wit :

be and the same is hereby amended so as to read as follows :

Section 5. That that portion of Section 5 of Ordinance No.
394 of the City of Miami Beach, reading as
follows, to-wit:

be and the same is hereby amended so as to read as follows :

Section 6. That that portion of Section 5 of Ordinance No.
394 of the City of Miami Beach, reading as
follows, to-wit:

amended by adding thereto, at the end thereof,
the following:

Section 16. That Section 5 of Ordinance No. 394 of the City
of Miami Beach, be_ and the same is hereby amended
by adding thereto an additional paragraph, read-
ing as follows, toT2wit :
"GROCERY STORES, retail, when the maximum valie
of stock of goods carried does not exceed
$1,000 . . . . . . . . . . . . . . . . . . . $ 25.00
For each additional 41,000. of stock
carried, or fractional part thereof . . . . . 5.00"
said additional paragraph to be inserted in said Section 5
immediately preceding that portion of said section which reads
as follows, to-wit :

Section 17. That that portion of Section 5 of Ordinance No.

Section 19* All ordinances and parts of ordinances in conflict herewith
are hereby repealed.
Section 20. Should any section or part of this ordinance be held by a
Court of competent jurisdiction to be invalid for any reason,
such facts shall not affect the validity of other parts
hereof*
Section 21* All of the remaining sections and provisions of Ordinance
No. 394 not changed or affected by this Ordinance shall
continue in full force and effect*

MIANI BEACH, FLORIDA, AMENDING SECTION 5 OF ORDINANCE NO.
394 IMPOSING LICENSES AND OTHER TAXES ON PRIVILEGES,
BUSINESSES AND OCCUPATIONS BY CHANGING THE LICENSES AND
TAXES IMPOSED ON CERTAIN BUSINESSES SET FORTH AND DESCRIBED
IN SAID SECTION 5 AND ADDING TO SAID SECTION 5 CERTAIN
ENUMERATED BUSINESSES AND IMPOSING LICENSES THEREON" , having
been passed and adopted by the City Council of the City of
Miami Beach, Florida, has been posted by me in three con-
spicuous places in the City of Miami Beach, one of which was
at the door of the City Hall in said City on the 16th day of
October, A. D. , 1941, and that said Ordinance remained posted
for a period of at least thirty days in accordance with the
requirements of the City Charter of the said City of Miami
Beach.
