Ordinance 643 ORDINANCE NO. 6 .3 AN ORDINANCE OF THE CITY OF MIAMI BEACH, FLORIDA, TO AMEND SECTION 1, OF ORDINANCE NO. 590, RELATING TO THE LICENSING AND REGU- LATING OF ANY PEF:SON, FIRM, OR CORPORATION ENGAGED IN THE BUSINESS OF DISPLAYING, SELLING OR OFFERING FOR SALE ANY SHEET, PAPER OR PAMPHLET PREDICTING THE RESULT OF A HORSE OR DOG RACE, BY ADDING TWO PARAGRAPHS THERETO AND PROVIDING IN SAID AMENDMENT THAT ORDINANCE NO. 590 SHALL NOT APPLY TO CERTAIN PERIODICAL PUBLICATIONS, RADIO STATIONS OR TO PROGRAMS CUSTOMARILY SOLD BY OPERATORS OF RACE TRACKS WITHIN THE ENCLOSURE OF ANY RACE TRACK, OPERATING UNDER THE CONTROL AND SUPERVISION OF THE FLORIDA STATE RACING COMMISSION; AND TO PROVIDE FOR THE DEFINITION OF "PERIODICAL PUBLICATIONS" . BE IT ORDAINED BY THE CITY COUNCIL OF MIAMI BEACH, FLORIDA: SECTION 1: That Section 1, of Ordinance No. 590, of the City of Miami Beach, Florida, be, and the same is, hereby amended by adding thereto two paragraphs numbered four and five, respectively, to read as follows : (4) This ordinance shall not apply to periodical publications as hereinafter defined, radio stations or to the programs customarily sold by the operators of race tracks within the enclosure of race tracks operated under the control and supervision of the Florida State Racing Commission. (5) For the purpose of this ordinance the term periodical publicE..tions be, and the same is, hereby defined as being a sheet, paper, periodical, publication, newspaper, magazine or pamphlet printed and published continuously and periodically without any interruptions once a week, or more often, solely or in a large part in the English language, circulated and displayed to the public generally, customarily containing information, facts, words, and/or figures of either a public, sporting or racing character, or of interest, or of value, to the residents, visitors, tourists, or owners of property in the county and city where it is published, circulated and sold, or of interest or value to the public generally, having a bona fide list of actual individual or news dealer subscribers and having clearly printed thereon the name of the sheet, paper, periodical, publication, news- paper, magazine or pamphlet, the address of its principal place of business and if owned by an individual or indi- viduals the names and addresses of such individuals, to- gether with the names and addresses of the publisher, editor and manager, or if the sheet, paper, periodical, publication, newspaper, magazine or pamphlet is owned by a corporation, the name of the president, vice-president, if any, and the secretary and/or treasurer. SECTION 2: All ordinances, and/or parts of ordinances, in conflict herewith be, and the same are, hereby repealed.
