Resolution 290 mow RESOLUTION No. 2 11_ • A RESOLUTION OF ,THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE ISSUANCE OF $70,000 SEWAGE DISPOSAL BONDS AND $55,000 SANITARY SEWER BONDS AUTHORIZED BY THE REGISTERED AND QUALIFIED VOTERS OF SAID CITY AT AN ELECTION HELD IN SAID CITY JULY 25, 1922, AND REPEALING RESOLUTION No. 286 AUTHORIZING THE ISSUANCE OF $125,000 MUNICIPAL IMPROVEMENT BONDS, WHICH RESOLUTION WAS PASSED AND ADOPTED JULY 26, 1922. • WHEREAS The City Council of the City of Miami Beach, Florida, heretofore passed an ordinance authorizing the is- suance of bonds for said City in the sum of Seventy Thousand Dollars for the purpose of constructing a building, the laying of drains and the purchase of land, machinery arra equipment, all for the operation of a plant for neutraliz- ing, destroying and disposing of sew age and Fifty-five thousand Dollars for the construction of sanitary sewers, and in said ordinance called a special election to be held in said City on July 25th, 1922, for the purpose of submitting said' question to the qualified voters of said City, and WHEREAS the said City Council on July 26th, 1922, canvassed the returns of the aforesaid election and found that a majority of the votes cast upon each of the aforesaid questions was for the issuance of said bonds, and declared the result of said election and canvass. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA: Section 1. That the negotiable coupon bonds of the City of Miami Beach are hereby directed to be issued and sold in the aggregate amount of $70,000 for the purpose of constructing a building, the laying of drains and the pur- chvI of land, machinery andequipment, all for the opera- ' ton of a plant for neutralizing, destroying and disposing CHESTER S. NEW YORE 2 of sew age .. for said City, such bonds to consist of 70 bonds of $1,000 each, numbered 1 to 70, both inclusive, dated July I, 1922 and maturing in numerical order, lowest numbers first, $5,000 annually July 1, 1924 to 1937, both inclusive. Section 2. That the negotiable coupon bonds of the City of Miami Beach are hereby directed to be issued and sold in the aggregate amount of $55,000 for the purpose of construct- ing sanitary sewers for said City, such bonds to consist of . ( 55 bonds of $1,000 each, numbered 71 to 125, both inclusive, _dated July 1, 1922 and maturing in numerical order, lowest numbers first, $2,000 annually July 1, 1924 to 1937, $7,000 all inclusive annually July 1, 1938 to 1940^and $6,000 July 1, 1941. Section 3. That all of the said bonds aggregating $125,000 shall bear interest at 6% per annum, payable semi- 1 annually on the first days of January and July of each year, both principal and interest to be payable at the United States Mortgage & Trust Company in the City of New York in gold coin of the United States of the present standard of weight and fineness. Section 4. That all of said bonds shall be signed by the Mayor and Clerkand attested by the City Auditor, and sealed with the corporate seal, and the interest coupons thereto attached shall be signed by said City Clerk whose signature upon said coupons may be in facsimile; and said bonds and coupons shall be in substantially the following form: $1,000 No. UNITED STATES OF AMERICA State of Florida, County of Dade, City of Miami Beach, Public Improvement Bond (Bonds numbered 1 to 70 are Sewage Dispos- al Bonds. Bonds numbered 71 to 125 are Sanitary Sewer Bonds. ) KNOW ALL MEN BY THESE PRESENTS: That the City of Miami Beach, in the County of Dade and State of Florida, is CHESTER B. MASSLICH. NEW YORK 3 justly indebted and for value received, hereby promises to pay to the bearer on the first day of July, 19 , the prin- cipal sum of ONE THOUSAND DOLLARS with interest thereon at the rate of six per centum per an- num, payable semi-annually on the first days of January and July in each year, upon the presentation and surrender of the annexed interest coupons as they severally become due- Both principal and interest of this bond are payable in gold coin of the United States of the present standard of weight and fineness at the United States Mortgage & Trust Company, in the City of New York and State of New York. This bond is one of a series of 125 bonds of like data and amount, aggregating $125,000, numbered from 1 to 125, both inclusive, of which bonds numbered 1 to 70 aggregating $70,000 are issued for the purpose of constructing a build- , $ ing, the laying of drains and the purchase of land, machinery Viand equipment, all for the operation of a plant for neutraliz- i ing, destroying and disposing of sew age for said City, and ! bonds numbered 71 to 125 aggregating $55,000 are issued for the construction of sanitary sewers for said City. This ( bond is issued under the authority of and in full compliance ( with the charter of said City, being Chapter 7672, Acts of lithe Legislature of Florida for the year 1917, as amended, and la vote of a majority of the duly registered and qualified voters of said City voting separately upon each of said two classes of bonds at aspecial election duly called, held f July 25, 1922, and resolutions duly passed by the City Council !: of said City. The full faith, credit and resources of said City of Miami Beach are hereby irrevocably pledged to the prompt payment of the principal and interest hereof as the same shall fall due. NEW YORK 4 exist or be performed precedent to and in the issuance of this bond by said charter and the laws and constitution of Florida, have happened, exist and have been performed as so required; that provision has been made for the levy and collection of a direct annual tax upon all taxable property within said City sufficient to pay the interest and principal of this bond as the same shall fall due; and that the total indebtedness of said City, including this ' bond, does not exceed any constitutional or statutory limitation thereon. IN WITNESS WHEREOF, said City of Miami Beach has caused this bond to be signed by its Mayor and Clerk under its corporate seal, and attested by its Auditor, and the interest coupons hereto attached to be signed with the facsimile signature of said Clerk, all as of the first day of July, 1922. " Section 6. That there shall be and hereby is levied upon all the taxable property in the City of Miami Beach in each year while any of the said Sewage Disposal Bonds, numbered 1 to 70, are outstanding a direct annual tax eifficient to pay the principal and interest of said Sewage Disposal Bonds as the same shall become due and payable under this resolution. Section 7. That there shall be and hereby is levied upon all the taxable property in the City of Miami Beach in each year while any of the said Sanitary Sewer Bonds, numbered 71 to 125, are outstanding a direct annual tax sufficient to pay the principal and interest of said Sanitary Sewer Bonds as the same shall become due and payable under this resolution. Section 8. That the taxes herein levied and directed to be levied shall be collected as other city taxes and shall la be used for no other purpose than the payment of the principal and interest of the bonds for which they are herein provided, respectively. Section 9. That Resolution No. 286, passed and adopted July 26, 1922, entitled ! "A RESOLUTION OF THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE ISSUANCE OF BONDS IN THE SUM OF ONE HUNDRED TWENTY-FIVE THOUSAND DOLLARS AUTHORIZED BY THE REGIS- TERED AND QUALIFIED VOTERS OF SAID CITY AT AN ELECTION HELD IN SAID CITY JULY 25th, 1922" CHESTER B.
