Ordinance 655 ORDINANCE NO. 655 AN ORDINANCE AMENDING SECTION 14 OF ORDINANCE NO. 289 OF THE CITY OF NIIAviI BEACH, FLORIDA. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1. That that portion of Section 14 of Ordinance No, 289 of the City of Miami Beach, Florida, reading as follows : "Whenever a non-conforming use of a building has been discontinued for a period of one (1) year or more, such non-conforming use shall not thereafter be re-established and the future use shall be in conformity with the provisions of this Ordinance." be and the same is hereby amended so as to read as follows : "Whenever a non-conforming use of a building has been discontinued for a period of one (1) year or more, such non-conforming use shall not thereafter be re-established, and the future use shall be in conformity with the provisions of this Ordinance; provided, however, that any use of any land or buildings in which a non- conforming use exists as hereinabove provided, by any branch of the military service of the United States of America, during a state of war, shall not be deemed, or held to be, an abandon- ment, or discontinuance, of the non-conforming use thus vested in said land." SECTION 2. That this Ordinance shall go into effect immediately upon its becoming a law. PASSED AND ADOPTED this 20th day of May, A. D. , 1942.
