Ordinance 667 ORDINANCE NO. 667 AN ORDINANCE REGULATING THE LAUNDRY BUSINESS AND DRY CLEANING BUSILESS, INCLUDING AGENCIES FOR LAUNDRY AND DRY CLEANING BUSINESSES, II THE CITY OF MIAMI BEACH, FLORIDA, BY REQUIR- ING THE POSTING OF A BOND FOR THE PROTECTION OF CUSTOMERS OF SUCH BUSI- NESSES. BF IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA; SECTJ:ON 1. It shall be unlawful for any person, firm or corpora- tion to operate a laundry or dry cleaning business or to operate any agency for any laundry or dry cleaning business or in anywise to solicit persons resident of the City of Miami Beach, Florida, for laundry and dry cleaning work without first posting a bond with the City Clerk of the City of Miami Beach, in a Sum of not less than $1,000.00 with a surety company licensed to do business in the State of Florida as surety, which bond shall be payable to the City of Miami Beach, Florida, for the use and benefit of all persons doing business with the obligor named in said bond and said bond shall be conditioned that the obligor in said bond shall redeliver, without damage, to the owner thereof or his agent, all clothing and wearing apparel or other personal property received by the said obligor from the owner or his agent within the City of Miami Beach for laundering, dry cleaning or otherwise processing in such manner as said obligor shall have contracted. SECTION 2. The City ii.ttorriey of theCity of Miami Beach shall have the authority to approve, on behalf of the City, bonds complying with the terms of this ordinance and to disapprove bonds tendered to him to be filed as required by this ordinance which do not meet the above requirements and which do not expressly provide that any person or persons who shall have transacted business with the obligor in any such bond and who shall not have had his proper- ty returned to him undamaged, may, in addition to any other remedy afforded by law, bring suit on such bond in the name of the City of Miami Beach, for the use and benefit of such person or persons. SECTION 3. Violation of this ordinance shall be punished by a fine of not more than $500.00 or by imprisonment of not more than six months, or by both such fine and imprisonment. Each day-lb violation hereof shall be treated as a separate of- fense hereunder. SECTION 4. The following quoted subsection of Section 5 of Ordi- nance No. 394, to-wit: uAll persons, firms or corporations engaged in the laundry or dry cleaning business with or without established places of business, shall post with the City of Miami Beach a bond in the amount of One Hundred ($100.00) Dollars to guarantee safe delivery without damage all laundry and dry cleaning work obtained in said City", is hereby expressly repealed. All other ordinances and parts of ordinances in conflict herewith are hereby repealed. SECTION 5. This ordinance shall take effect immediately upon passage and adoption. D. , 1942, and that said Ordinance remained posted for a period of at least thirty days in accordance with the require- ments of the City Charter of the said City of Miami Beach.
