Ordinance 675 ORDINANCE NO. 675 AN ORDINANCE AMENDING SECTION 5 OF ORDINANCE NO. 394 OF THE CITY OF MIAMI BEACH, FLORIDA, ENTITLED: "AN ORDINANCE OF TEE CITY OF MIAMI BEACH, FLORIDA, IMPOSING LICENSES AND OTHER TAXES ON PRIVILEGES, BUSINESSES, OCCUPATIONS AND PROFESSIONS CARRIED ON AND ENGAGED IN WITHIN SAID CITY, AND PRESCRIBING PENALTIES FOR THE EXERCISING OF SUCH PRIVILEGES OR CAR.. RYING ON SUCH BUSINESSES, OCCUPATIONS OR PRO— FESSIONS, WITHOUT A LICENSE OR OTHER FAILURE TO COMPLY WITH THE PROVISIONS THEREOF. " BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1. That that portion of Section 5 of Ordinance No. 394 of the City of Miami Beach, Florida, reading as follows: "Night Clubs or Supper Clubs , Restaurants, Dining Rooms or other establishments where floor shows or other form of entertainment is provided for guests after 11:00 o ' clock P. M. , shall pay a license fee of Two Thousand Dollars 02,000.00) in addition to their regular Restaurant License. " be and the same is hereby amended so as to read as follows: " 'Night Clubs ' which are defined to be Restaurants, Dining Rooms, or other establishments where intoxi— cating liquor is sold, given away or consumed on the premises, and where floor shows or other forms of entertainment are provided for guests on week days between the hours of midnight and 7:00 o' clock A.M. and on Sundays between the hours of 1:00 o' clock A.M. and 7:00 o'clock A.M. , shall pay a license fee of Two Thousand Dollars (42,000.00) in addition to their regular restaurant license and in addition to their license for the sale of intoxicating liquor. 'Cabarets' which are defined to be Restaurants, Dining Rooms or other establishments where intoxi— eating liquor is sold, given away or consumed on the premises, and where the form of entertainment provided for guests shall be other than mechanical phonographs, radio and/or string music, and where such entertainment is not provided on any week day between the hours of midnight and 7:00 o' clock A.M. , or on Sundays between the hours of 1:00 o'clock A.M. , and 7:00 o' clock A.M. shallay a license fee of Five Hundred Dollars ($500.00p) in addition to their regular restaurant license and in addition to their license for the sale of intoxicating liquor. " SECTION 2. That all ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. SECTION 3. This ordinance shall go into effect immediate— ly upon its becoming a law. D. , 1943 and that said Ordinance remained posted for a period of at least thirty days in accordance with tke requirements of the City Charter of the said City of Miami Beach.
