NO. 723 AN ORDINANCE AMENDING SECTIONS 1 AND 3 OF ORDINANCE NO. 659 OF THE CITY OF MIAMI BEACH, FLORIDA, ENTITL D: "AN ORDINANCE OF THE CITY OF MIAMI BEACH, FLORIDA, PRO- VIDING FOR THE LICENSING OF PACKERS AND/OR SHIPPERS OF FRUITS, NUTS, CRYSTALLIZED CANDIES OR CANDIED FRUITS, COCOANUT LAMPS OR COCOANUT NOVELTIES; PROVIDING THAT A BOND INDEMNIPYING THE PUBLIC AGAINST LOSS BY FRAUD OF THE SAID PACKER, PACKERS AND/OR SHIPPERS SHALL BE POSTED WITH THE CITY OF MIAMI BEACH, FLORIDA, BEFORE THE ISSUANCE OF A LICENSE; PROVIDING THE TERMS AND CON- DITIONS OF SAID BOND; PROVIDING FOR THE REVOCATION OF A LICENSE ISSUED UPON THE CANCELLATION OF SAID BOND; EXEMPTING PACKERS AND/OR SHIPPERS SELLING QUANTITY OR BULK SHIPMENTS TO THE OPEN MARKET OR IN REGULAR WHOLESALE OR COMMISSION' MERCHANT CHANNELS; PROVIDING PENALTIES FOR TEE VIOLATION OF SAID ORDINANCE. " BE IT ORDAINED BY THE CITY COUNCIL OF TIE CITY OF MIAMI BEACH, FLORIDA : SECTION 1. That Section 1 of Ordinance No. 659 of the City of Miami Beach, Florida, be and the same is hereby amended to read as follows : "It shall be unlawful for any person, firm or corporation to engage in the business of pack- ing and/or shipping, or to engage in the busi- ness of soliciting orders for the packing and/or shipping, of fruits, nuts, jellies, crystallized candies, candied fruits, cocoanut lamps, or cocoanut novelties, in the City of Miami Beach, Florida, without first obtaining from the City Clerk of said City, a City license for the opera- tion of said business. Said license may be ob- tained as hereinafter set forth. " SECTION 2. That Section 3 of Ordinance No. 659 of the City of Miami Beach, Florida, be and the same is hereby amended to read as follows : 'Application for said license shall be made on a form to be provided by the said City Clerk. Before the issuance of the said license, the applicant shall execute and post with the City of Miami Beach, Florida, a bond in the sum of One Thousand Dollars to be approved by the City Attorney of the City of Miami Beach, Florida, said bond to indemnify the pub- lic against any loss by fraud on the part of such licensee. Said bond shall provide in its terms that the principal, the sureties thereon, or the Company writing said bond, shall give the City of Miami Beach, Florida, not less than ten ( 10) days written notice of the cancellation of said bond in the event of the cancellation thereof for any reason, or that said bond has become void for any reason. Upon the filing of a proper application and a bend drawn in ( 1) conformity with the foregoing and approved as aforesaid, and upon the payment of the fee hereinabove provided, the City Clerk shall issue said license. " SECTION 3. This ordinance shall go into effect immediately upon its passage and posting as required by law. PASSED and ADOPTED this 20th day of December, A. D. 1944. " , having been passed and adopted by the City Council of the City of Miami Beach, Florida, has been posted by me in three conspic- uous places in the City of Miami Beach, Florida, one of which was at the door of the City Hall in said City on the 20th day of December, A.D. 1944, and that said Ordinance remained posted for a period of at least thirty days in accordance with the requirements of the City Charter of the said City of Miami Beach.
