AN ORDINANCE AMENDING A PORTION OF SECTION
5 OF ORDINANCE NO. 394 OF THE CITY OF
MIAMI BEACH, FLORIDA, ENTITLED: "AN ORD I-
NANC E OF THE CITY OF MIAMI BEACH, FLORIDA,
IMPOSING LICENSES AND OTHER TAXES ON PRIV-
ILEGES, BUSINESSES, OCCUPATIONS AND PRO-
FESSIONS CARRIED ON AND ENGAGED IN WITHIN
SAID CITY, AND PRESCRIBING PENALTIES FOR
THE EXERCISING OF SUCH PRIVILEGES OR CARRY-
ING ON SUCH BUSINESSES, OCCUPATIONS OR PRO-
FESSIONS, WITHOUT A LICENSE OR OTHER FAILURE
TO COMPLY WITH THE PROVISIONS THEREOF. "
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA:
SECTION 1, That that portion of Section 5 of Ordinance No, 394 of
the City of Miami Beach, Florida, reading as follows:
"NIGHT CLUBS which are defined to be restaurants,
Dining Rooms, or other establishments where in-
toxicating liquor is sold, given away or consumed
on the premises, and where floor shows or other
forms of entertainment are provided for guests on
week days between the hours of midnight and 7:00
o'clock A, M. and on Sundays between the hours of
1:00 o'clock A. M. and 7:00 o'clock A. M., shall
pay a license fee of Two Thousand Dollars ($2,000,00)
in addition to their regular restaurant license
and in addition to their license for the sale of
intoxicating liquor,
"CABARETS which are defined to be Restaurants,
Dining Rooms or other establishments where intox-
icating liquor is sold, given away or consumed on
the premises, and where the form of entertainment
provided for guests shall be other than mechanical
phonographs, radio and/or string music, and where
such entertainment is not provided on any week day
between the hours of midnight and 7:00 o'clock A,
M. , or on Sundays between the hours of 1:00 o' clock
A. M., and 7:00 o'clock A, M. shall pay a license
fee of Five Hundred Dollars ($500.00) in addition
to their regular restaurant license and in addition
to their license for the sale of intoxicating liquor. "

of entertainment are provided for guests at any
time between the hours of midnight and 7:00 o'clock
A. M. shall pay a license fee of Two Thousand Dollars
($2,000.00) in addition to their regular restaurant
license and in addition to their license for the sale
of intoxicating liquor. "
SECTION 2. That all ordinances or parts of ordinances in conflict
herewith be and the same are hereby repealed.
SECTION 3. That this ordinance shall go into effect immediately
upon its passage and posting as required by law.

LEGES, BUSINESSES, OCCUPATIONS AND PROFESSIONS CARRIED ON
AND ENGAGED IN WITHIN SAID CITY, AND PRESCRIBING PENALTIES
FOR THE EXERCISING OF SUCH PRIVILEGES OR CARRYING ON SUCH
BUSINESSES, OCCUPATIONS OR PROFESSIONS, WITHOUT A LICENSE
OR OTHER FAILURE TO COMPLY WITH THE PROVISIONS THEREOF",
having been passed and adopted by the City Council of the
City of Miami Beach, Florida, has been posted by me in three
conspicuous places in the City of Miami Beach, Florida, one
of which was at the door of the City Hall in said City on
the 3rd day of October, A. D. 1945, and that said Ordinance
remained posted for a period of at least thirty days in ac-
cordance with the requirements of the City Charter of the
said City of Miami Beach.
IN WITNESS WHEREOF I have hereunto set my
hand and affixed the official seal of the City of Miami Beach,
Florida, on this the 6th day of November, A. D. , 1945.
