ORDINANCE NO. 753
AN ORDINANCE AMENDING ORDINANCE NO. 394
OF THE CITY OF MIAMI BEACH, FLORIDA, EN-
TITLED: "AN ORDINANCE OF THE CITY OF
MIAMI BEACH, FLORIDA, IMPOSING LICENSES
AND OTHER TAXES ON PRIVIL1 ES, BUSINESSES,
OCCUPATIONS AND PROFESSIONS CARRIED ON
AND ENGAGED IN WITHIN SAID CITY, AND PRES-
CRIBING PENALTIES FOR THE EXERCISING OF
SUCH PRIVILEGES OR CARRYING ON SUCH BUSI-
NESSES, OCCUPATIONS OR PROFESSIONS, WITHOUT
A LICENSE OR OTHER FAILURE TO COMPLY WITH
THE PROVISIONS THEREOF. "
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA:
SECTION 1. That that portion of Section 5 of Ordinance No.394 of
the City of Miami Beach, Florida, reading as follows:
"AMUSEMENT AND RECREATION
AUTOMATIC COIN GAMES (See Marble, Music or Picture Machines)
BALL ROOMS (See Dance Halls)
BAGATELLE TABLES (See Billiards)
BILLIARD OR POOL TABLES, persons maintaining same for
profit direct or indirectly, or the proprietor
thereof, each $ 2.50
BOWLING ALLEYS, or box ball alleys, per alley 10. 00
BOX BALL ALLEYS (See Bowling Alleys)
CABANAS, each 1.00
CIRCUS, any performance or show given under canvas
or tent (except dogs or trained animal
exhibition) for profit, each performance 500.00
CIRCUS, for each parade through the streets when
performance is given outside City limits 100.00
CORN, KENO, FORTUNE or similar games with standing
or seating capacity accommodating 75 or less
patrons 1,000.00
The same accommodating over 75 patrons shall pay
an additional fee of $15.00 for each addi-
tional patron accommodated. (All license
for Corn, Keno, Fortune or similar games,
subject to the approval of the City Council. )
DANCE HALLS and BALL ROOMS, public, each Dance Hall
or Ball Room 250.00
DOG or other trained animal exhibition, each day . . . 50.00
DOG or other trained animal exhibition, each PARADE
where performance is given outside City limits, . . 25.00
FORTUNE TET,LhQRS, Palmists, Hypnotists, Clairvoyants,
Astrologers, Phrenologists, Physiognomists,
Numerologists, Mind Readers, and others of a
similar nature, whether or not in connection
with another business, each 100.00
Where done gratuitously 50.00
Provided, that before license is issued to any
persons, pursuant to the foregoing item, a
report must be made by the Police Department
to the effect that the applicant or applicants
have no record of conviction in any case in-
volving a felony, and the application must be
accompanied by three or more character references
GAMES AND DEVICES, such as Ball Throwing at figures,
BALL ROLLING, CANE RACKS, DOLL RACKS, HOOP THROWING,
KNIFE RACKS, or other games or devices, operated
for profit, each game or device (subject to
approval of the City Council) 50.00
GOLF, practice or driving courses . 25.00
GOLF, miniature, Tom Thumb, Pony or similar courses
(see Miniature Golf Courses)
MARBLE MACHINES, Automatic Coin Games or devices of
skill or other similar machines or games,
operated for profit, each machine 25.00
Every person, firm or corporation, selling,
leasing or renting one or more marble machines,
automatic coin games or devices of skill, or
other similar machines or games operated for
profit, alone or in connection with any other
business shall, as a prerequisite, be required
to pay a license fee as follows:
Said applicant desiring to sell, lease or rent
one or more marble machines, automatic coin
games or devices of skill, or other similar machines
or games operated for profit, alone or in connection
with any other business, shall file with the License
Department, in person if a natural person, or by
the duly authorized agent or officer of the firm
or corporation, a written application for a license
to do business in the City of Miami Beach, Florida,
Such license shall issue to the applicant and shall
entitle the applicant to engage in the selling,
leasing, or renting of one or more machines, games
or devices as above described, alone or in connect-
ion with a ny other business, upon the payment of
a license fee of
TWO HUNDRED DOLLARS 200.00
It is hereby understood that the foregoing pro-
visions shall not apply to or cover automatic
coin devices vending merchandise only.
It is further understood that this shall not be
construed to license or permit the operation of
gambling devices.

It is hereby understood that the payment of the

profit, shall be in addition to the individual
license charged by the City of Miami Beach for

40 machines *1,250.00
For selling, leasing or renting, each
additional machine 25 .00
The foregoing provisions shall not apply to or
cover automatic coin devices vending merchandise
only.
The provisions hereof shall not be construed to
license or permit the operation of gambling de-
vices. "
SECTION 2. That that portion of Section 5 of Ordinance No. 394
of the City of Miami Beach, Florida, reading as follows:
"MUSIC, furnished by telephone wire
(covering ten locations) - . 250.00
Each additional location 10.00"
be and the same is hereby amended to read as follows:
"MUSIC, furnished by telephone wire 300.00"

SECTION 3. That that portion of Section 5 of Ordinance No. 394
of the City of Miami Beach, Florida, reading as
follows:
"CONCESSIONAIRES, at Night Clubs, each location . . . . $250.00"
be and the same is hereby amended to read as follows:
"CONCESSIONS (with the exception of fortune
tellers) at Night Clubs,
each location 250.00"
SECTION 4. That that portion of Section 5 of Ordinance No. 394
of the City of Miami Beach, Florida, reading as
follows:
"ROOMING HOUSES, or LODGING HOUSES in which there are more
than three beds for the use of occupants,
lodgers, roomers or boarders, or in which more
than six persons in said lodging house or room-
ing house are allowed to sleep, shall pay a
minimum fee of 25.00"
be and the same is hereby amended to read as follows:
"ROOMING HOUSES, or LODGING HOUSES in which there are more
than three beds for the use of occupants,
lodgers, roomers or boarders, or in which
more than six persons in said lodging house
or rooming house are allowed to sleep,
shall pay a minimum fee of 50.00"
SECTION 5. That that portion of Section 5 of Ordinance No. 394
of the City of Miami Beach, Florida, reading as
follows:
"GROCERY STORES, retail, when the maxillium value of
stock of goods carried does not exceed
$1,000.00 . . . . . . . . . . . . . . . . . . . . 25.00
For each additional $1,000 of stock
carried or fractional part thereof 5 00"

SECTION 6. That that portion of Section 5 of Ordinance No. 394
of the City of Miami Beach, Florida, reading- as
follows:

AUTOMOBILES-FOR-HIRE (except sightseeing busses and
then only after complying with FOR-HIRE Ordinance
No. 356) per auto 15.00
SIGHTSEEING BUSSES, each bus . . . . 25.00
AUTOMOBILE RENTING BUSINESS (Provided that automobiles rented
with drivers shall be subject to same regulations
as are specified in For-Hire Ordinance No. 356 . . 250.00"
