Ordinance 770 ORDINANCE NO. 770 AN ORDINANCE AMENDING ORDINANCE NO. 391 OF THE CITY OF MIAMI BEACH, FLORIDA, ENTITLED: "AN ORDINANCE PROVIDING FOR AND REQUIRING THE LI- CENSING OF ALL PERSONS, FIRMS AND CORPORATIONS SELLING, MANUFACTURING OR RECTIFYING LIQUORS AND BEVERAGES CONTAINING ALCOHOL; DEFINING CERTAIN TERMS AS SET FORTH HEREIN; PROVIDING THAT NO LICENSE SHALL BE TRANSFERABLE AND NO EXEMPTION FROM TAXES SHALL BE HAD; PROVIDING AND FIXING THE AMOUNT OF LICENSE FEES; PRO- VIDING FOR APPLICATION AND ADVERTISING THEREOF; MAKING IT UNLAWFUL TO SELL LIQUORS AND ALCOHOLIC BEVERAGES TO CERTAIN PERSONS; FIXING CERTAIN HC URS WHEN LIQUOR OR ALCOHOLIC BEVERAGES MAY NOT BE SOLD OR DELIVERED IN THE CITY OF MIAMI BEACH; PROHIBITING CURB SERVICE OF LIQUORS AND INTOXI- CATING BEVERAGES EXCEPT BEER; PROHIBITING THE SALE OF LIQUOR OR INTOXICATING BEVERAGES AT ANY GASOLINE FILLING STATIONS; CREATING POSITION OF LIQUOR INSPECTOR AND PRESCRIBING THE DUTIES THEREOF; PROVIDING FOR CERTAIN RESTRICTIONS ON THE PREMISES WHE=.t'• LIQUORS AND ALCOHOLIC BEVERAGES ARE SOLD AND OFFERED FOR SALE; PRESCRIBING REGU- LATIONS FOR THE HANDLING OF INTOXICATING LIQUORS; PROVIDING FOR A PENALTY FOR THE VIOLATION OF THIS ORDINANCE, AND PROVIDING THAT THE CITY COUNCIL MAY REVOKE A LICENSE AS ISSUED UNDER THIS ORDINANCE; REPEALING ALL LAWS AND PART OF LAWS IN CONFLICT HEREWITH; DECLARING THIS ORDINANCE TO BE AN EMER- GENCY MEASURE. " BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1 : That Ordinance No. 391 of the City of Miami Beach, Florida, be and the same is hereby amended by adding, thereto, immediately after Section 13, thereof, an additional section to be known as Section 13zj and reading as follows: "Section 13 : It shall be unlawful: (a) For any minor of the Age of Seventeen years or more to enter the premises of any vendor for the purpose of purchasing or having served or delivered to him or her any licuor, wine or beer. (b) For any minor of the age of seventeen years or more to misrepresent his or her age for the purpose of inducing any vendor or any employee of any vendor to sell or serve any liquor, wine or beer to him or her. ( c) For any minor of the age of seventeen years or more to purchase, or attempt to purchase or have another purchase for him or her, any liquor, wine or beer at the premises of a vendor. (d) For any parent or guardian to inten- tionally permit any minor child of which he or she may be the parent or guardian to violate the provi- sions of this Section. (e) For any Retail Vendor to fail to dis- play at all times in a prominent place in the place - 1 - of business of such vendor a printed card which shall read substantially as follows: "WARNING TO MINORS MALE OR FEMALE PERSONS BETWEEN 17 YEARS AND 21 YEARS OF AGE, UNDER CITY ORDI- NANCE, ARE SUBJECT TO FINE IF THEY: 1. ENTER LICENSED PREMISES TO BUY OR HAVE SERVED TO THEM ALCOHOLIC BEVERAGES; 2. PURCHASE OR ATTEMPT TO PURCHASE CR GET ANOTHER TO PURCHASE ALCOHOLIC BEVERAGES; 3. MISREPRESENT THEIR AGE FOR THE PURPOSE OF PURCHASING OR OBTAINING ALCOHOLIC BEVERAGES.
