Ordinance 771 ORDINANCE NO. 771 AN ORDINANCE AMENDING SECTIONS 5, 6, 7 AND 12 OF ORDINANCE NO. 394 OF THE CITY OF MIAMI BEACH, FLORIDA, ENTITLED: °AN ORDINANCE OF THE CITY OF MIAMI BEACH, FLORIDA, IMPOSING LICENSES AND OTHER TAXES ON PRIVILEGES, BUSINESSES, OCCUPATIONS AND PROFESSIONS CARRIED ON AND ENGAGED IN WITHIN SAID CITY, AND PRESCRIBING PENALTIES FCR THE EXERCISING OF SUCH PRIVILEGES OR CARRYING ON SUCH BUSINESSES, OCCUPATIONS OR PROFESSIONS, WITHOUT A LICENSE OR OTHER FAILURE TO COMPLY WITH THE PROVISIONS THERE- OF. ° BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1: That Section 5 of Ordinance No. 394 of the City of Beach, Florida, be and the same is hereby amended to read as follows: °Section 5: Each individual who acts as Agent, and each individual who acts as business or sales agent for a corporation engaged in any business mentioned in this section when his principal has not paid a license in accordance with this Ordinance, shall be required to take out a license as Agent in his own name. This sec- tion shall apply to every person who seeks, negotiates or transacts, for himself or for any other person or corporation mentioned in this Section, but not to inactive stockholders in corporation or members of agencies who do not attempt to transact any business for such agency. A license tax in the sum set opposite each of the follow- ing businesses, occupations or professions is hereby levied and imposed upon the business, occupation or pro- fession ro-yfession opposite which such sum is set. AMUSEMENT AND RECREATION BILLIARD or POOL tables, persons maintaining same for profit directly or indirectly, or the proprietor thereof, each $ 3.50 BOWLING ALLEYS, or box ball alleys, per alley 13.50 CABANAS, each 3.00 CIRCUS, any performance or show given under canvas or tent (except dogs or trained animal exhibition) for profit, each performance 675.00 CIRCUS, for each parade through the streets when performance is given outside City limits 135.00 DANCE HALLS and BALL ROOMS, public, each dance hall or ball room 350.00 DOG or other trained animal exhibition, each day 67.50 DOG or other trained animal exhibition, each parade where performance is given outside City limits . . . 35.00 FORTUNE TELLERS, Palmists, Hypnotists, Clairvoyants, Astrologers, Phrenologists, Physiognomtts, Numerologists, Mind Readers, and others of a similar nature, where not gratuitous or in a Night Club or as an accessory to the main business. . . 675.00 1 .» Where done gratuitously or where done in a Night Club or any place of business where it is an accessory to the main business 135.00 Provided, that before license is issued to any persons pursuant to the foregoing item, a report must be made by the Police Department to the effect that the applicant or applicants have no record of conviction in any case involving a felony, and the application must be accompanied by three or more character references. GAMES AND DEVICES, such as Ball Throwing at figures, BALL ROLLING, CANE RACKS, DOLL RACKS, HOOP THROWING, KNIFE RACKS, or other games or devices, operated for profit, each game or device ( subject to approval of the City Council . . . . 67.50 GOLF, practice or driving courses 35.00 MARBLE MACHINES, Automatic Coin Games or devices of skill or other similar machines or games, operated for profit. Every person, firm or corporation, selling, leasing or renting one or more marble machines, automatic coin games or devices of skill, or other similar machines or games operated for profit, alone or in connection with any other business shall, as a prerequisite, be required to pay a license fee as follows: Said applicant desiring to sell, lease or rent one or more marble machines, automatic coin games or devices of skill, or other similar machines or games operated for profit, alone or in connection with any other business, shall file with the License Department, in person if a natural person, or by duly authorized agent or officer of the firm or corporation, a written application for a license to do business in the City of Miami Beach, Florida. Such license shall issue to the applicant and shall entitle the applicant to engage in the selling, leasing, or renting of one or more machines, games or devices as above described, alone or in connection with any other business, upon the payment of a li- cense fee as follows: For selling, leasing or renting up to 4+0 machines 1675.00 For selling, leasing or renting, each additional machine 35.00 The foregoing provisions shall not apply to or cover automatic coin devices vending merchandise only. The provisions hereof shall not be construed to license or permit the operation of gambling devices. NIGHT CLUBS which are defined to be restaurants, dining rooms, or other establishments where intoxicating liquor is sold, given away or consumed on the premises, and where floor shows or other forms of entertainment are provided for guests at any time between the hours of midnight and 7:00 o' clock A. M. , shall pay a license fee of Two Thousand Dollars ($2,000.00) in addition to their regular restaurant license and in addition to their license for the sale of intoxicating liquor. CONCESSIONS, (with the exception of fortune tellers) at Night Clubs, each location 350.00 ORGAN GRINDERS, per week 7.50 RINK- SKATING, BICYCLE, OR OTHERS, owners or persons main- taining same ( subject to special permission from the City Council) 27.50 SHOOTING GALLERY (To close at ll.opo' clock P. HOTELS containing ten (10) or more guests rooms shall pay a minimum fee of 13.50 covering the first fifteen (15) rooms, plus a fee of 1.25 for each additional room over 15. ROOMING HOUSES or LODGING HOUSES in which there are more than three (3) beds for the use of occupants, lodgers, roomers or boarders, or in which more - 3 — than six (6) persons in said rooming house or lodging house are allowed to sleep, shall pay a fee of 50.00 Any apartment house, hotel or any other place serving meals or food requires a restaurant license, as follows: RESTAURANTS, DRUG STORES or OTHER ESTABLISHMENTS serving food (permitting the operation of cafe, cafeteria, public dining room, tearoom or restaurant) with chairs or stools, each to count as one seat,. shall pay a minimum fee of 35.00 covering the first thirty five (35) seats plus a fee of 1. 25 for each additional seat over 35. MANUFACTURERS The following businesses are classed as manufacturing, and eacn person, firm or corporation engaged in the operation of any of such businesses are required to take out a factory license, as follows: BAKERY BOOK BINDERY BRICK MAKERS CABINET MAKERS' SHOP CANDY AND CONFECTIONERY MAKERS CANNING FACTORIES, CANNING FRUITS, FISH, MOLASSES, SYRUP OR VEGETABLES, ETC. CARPENTER SHOPS CONCRETE OR CEMENT MANUFACTURERS of artificial stone, brick cement blocks, posts, ornaments, vases, or other articles of similar nature. DOORS, SASHES AND BLINDS FOUNDRIES FURNITURE MAKERS GOLD, SILVER OR NICKEL PLATING HARNESS AND SADDLERY ICE CREAM ICE JFT,LY AND PRESERVES LABORATORIES, CHEMICAL, DENTAL, OPTICAL OR X-RAY LUMBER AND PLANING MILLS OR MILLWORK MUSICAL INSTRUMENTS MATTRESS, PILLOWS OR SPRINGS MIRRORS MOSAIC, TERRAZZO AND TILE MULTIGRAPHING NEWSPAPERS OR PERIODICALS NOVELTY WORKS PAINT WORKS PICTURE FRAMING PRINTING - all kinds RUBBER STAMPS SEPTIC TANKS SHEET METAL WORKS and TIN SHOPS STONE CUTTERS TANK BUILDERS ALSO ALL OTHER MANUFACTURERS OF PRODUCTS NOT HERETOFORE MENTIONED. FACTORIES employing five hands or less 20.00 FACTORIES employing more than five and not over twenty-five hands 55.00 FACTORIES employing over twenty-five hands 67.50 MERCHANTS, STOREKEEPERS AND DEALERS All persons, firms or corporations engaged in the business of selling merchandise or goods of any kind, sort or description, are required to cover - 4 .. their operations by taking out a merchant' s license as follows: BAKERY GOODS MARKET (retail) and/or BAKERY GOODS DEPARTMENTS (within the meaning of this ordinance shall be construed as any place of business where bakery goods are sold at retail) when the maximum value of stock of goods carried does not exceed $1,000.00, shall pay a fee of 35.00 for each additional $1,000.00 of stock carried or fractional part thereof 10 00 CANVASSER, ITINERANT SOLICITORS or other persons who solicit orders or sell by sample or otherwise, goods, wares, or merchandise at retail 350 00 PROVIDED, HOWEVER, that before any license shall be issued to any Canvasser, Itinerant Solicitor or other person named above, a permit therefor must be secured from the City Manager, application therefor having been made at least Thirty (30) days prior to the granting of said permit. It is hereby made the duty of said City Manager to in- vestigate all applications therefor, and if said City Manager is satisfied that the said applicant is of good moral character, and in a legitimate business, and that the welfare of said City will not be jeopardized by the issuance of said license, he shall grant said permit, otherwise not. COLD DRINK STAND (whether operated in connection with any other business or not) such as cold drink stands in filling stations, grocery stores, etc 7.50 DECORATIVE ARTS, POTTERY, CHINA, VASES, ORNAMENTAL IRON, GLASS AND TILE ORNAMENTS Merchant' s License (as specified below) FLORISTS (subject to the provisions of Ordinance # 526) . . . . 50.00 FLOWER STANDS, selling cut or potted flowers or plants ( subject to the provisions of Ordinance # 526) , . . . 35.00 FROZEN FOODS, at retail, where not in connection with regularly licensed grocery store, shall pay a fee of . . 35.00 FRUITS AND VEGETABLE MARKETS, and/or fruit and vegetable departments (within the meaning of this ordinance shall be construed as any place of business where undried fruits and vegetables are sold at retail) when the maximum value of stock of goods carried does not exceed $500.00, shall pay a fee of 35.00 for each additional $1,000.00 of stock carried, or fractional part thereof 10.00 FUEL DEALERS (except fire wood) Fuel-oil, Coal, Coke, etc. , dealers 75.00 Bottled Gas, dealers 50.00 (Provided that bottled gas dealers also selling ranges and appliances shall pay an additional license fee of 67.50 GROCERY STORES (within the meaning of this ordinance shall be construed as any place of business where groceries and/or food products are sold at retail, not including undried fruits and vegetables, nor fresh meats, poultry, or pro- cessed meats not in cans, nor bakery products excepting wrapped bread) when the maximum value of stock of goods carried does not exceed $1,000.00 shall pay a fee of 67.50 - 5 - for each additional "1,000.00 of stock carried, or fractional p_'rt thereof 6.75 • GUM OR MERCHANDISE VENDING MACHINES, per machine ( except machines vending drinking cups or postage stamps) 3.50 ICE, MILK, WATER AND CITRUS JUICES, retailing, each vehicle 10.00 MEAT MARKETS, and/or MEAT DEPARTMENTS (within the meaning of this ordinance shall be construed as any place of business where fresh meats, poultry or processed meats not in cans are sold at retail) when the maximum value of stock of goods carried does not exceed $500.00, shall pay a fee of 35.00 for each additional $1,000.00 of stock carried, or fractional part thereof 10.00 NEWS DEPOT, not in connection with other business 15.00 PAWNBROKERS selling other than articles taken on pledge, must take out a regular merchant ' s license. Each per- son or firm engaged in the business of a pawnbroker or conducting a pawn broking shop in the City, shall keep a record and upon demand shall make a report to the Chief of Police or his representative of every article or thing pawned to or purchased by him or them. Said record and report to specify the article or thing, such as number, mark, and all other such details as will make identification of such article, or such articles or things, clear and positive; and such person or persons aforesaid shall hold their shop open to visi- tation or inspection by the police, and upon refusal of any pawnbroker at any time to submit to such visitation or inspection, his or their shop shall be immediately closed by the order of the Mayor. All licenses issued to pawnbrokers are subject to these provisions: Any violation of which will be punished by a revocation of their license; and no license issued to pawnbrokers shall be transferred from the person or firm to whom it was issued. PAWNBROKER selling articles taken on pledge in addition to his regular merchant' s license 350.00 SODA FOUNTAINS 25.00 Provided that SODA FOUNTAINS operated in connection with regularly licensed drug store, restaurant or confectionery store do not require a license. It is hereby made the duty of said City Clerk to investiote all applications there- for, and if said City Clerk is satisfied that said applicant is of good moral character and in a legitimate business, and that the welfare of said City will not be jeopardized by the issuance of said license, he shall grant said permit, otherwise not; and provided further that the City Clerk shall issue with each permit to operate such a vehicle, a metal tag designating that license has been paid on said vehicle, said tags to be numbered serially and the owner or operator of all vehicles so licensed shall be required to attach said tag on said vehicle in a conspicuous place. Failure to attach said tag to vehicle shall constitute a violation of this ordinance to the same extent as if licensee had never procured said license.
