Ordinance 780 ORDINANCE NO. 7EC AN ORDINANCE AMENDING SECTION 4 OF ORDINANCE No.. 424 OF THE CITY OF MIAMI BEACH, FLORIDA, ENTITLED: "AN ORDINANCE PROVIDING FOR THE IN- SPECTION AND/OR REFILLING OF FIRE EXTINGUISHERS REQUIRED BY LAW TO BE KEPT UPON PREMISES LOCATED IN THE CITY OF MIAMI BEACH; PROVIDED THAT SUCH INSPECTION AND/OR REFILLING OF SUCH FIRE EX- TINGUISHERS BE MADE BY ONE OR MORE INSPECTORS AUTHORIZED AND APPROVED BY THE CHIEF OF THE MIAMI BEACH FIRE DEPARTMENT; REQUIRING THE REPAIR OR REPLACEMENT OF ANY FIRE EXTINGUISHER FOUND UPON INSPECTION TO BE DEFECTIVE: PRESCRIB- ING ANNUAL FEES TO BE CHARGED AND COLLECTED FOR SUCH INSPECTIONS; ESTABLISHING CHARGES TO BE MADE FOR REFILLING FIRE EXTINGUISHERS; PROVIDING PENALTIES FOR REFUSING TO PERMIT SUCH INSPECTIONS AND/OR PAY THE INSPECTION FEES PRESCRIBED BY THIS ORDINANCE". BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1: That Section 4 of Ordinance No. 424 of the City of Miami Beach, Florida, be and the same is hereby amended to read as follows: "SECTION 14 : When upon inspection, any fire extinguisher described in Section 1 hereof is found to be in need of refilling with the chemical solution intended and/or required by law to be used therein, the person legally required to keep such extinguisher upon the premises shall cause the same to be refilled immediately with--the proper chemical solution. At the option of such person, such refilling may be done either by an individual, firm or corporation approved by the Chief of the Miami Beach Fire Department, selected by such person, or by the inspector who has determined that such refilling is necessary. "In the event that any person legally required to keep one (1) or more fire extinguishers upon premises located in the City of Miami Beach, shall authorize and instruct an inspector as herein described to refill any such fire extinguisher, such person shall pay to the inspector at the time of refilling of such extinguisher the appropriate refilling charge as shown by the following schedule. "Any fire extinguisher which has been refilled by an in- spector as provided in this section and the contents of which after refilling are used for the purpose of extin- guishing a fire, shall be refilled again by the same or another inspector without any charge being made. therefor. D. , 1946, and that said Ordinance remained posted for a period of at least thirty days in accordance with the reauirements of the City Charter of the said City of Miami Beach.
