Ordinance 797 ORDINANCE NO. 797 AN ORDINANCE OF THE CITY OF MIAMI BEACH, FLORIDA, PROVIDING FOR VARIANCE AND RE- LAXATION OF THE PROVISIONS OF THE MIAMI BEACH BUILDING CODE IN THEIR APPLICATION TO FISHERS' ISLAND AND VIRGINIA KEY; AND REPEALING ORDINANCES IN CONFLICT HEREWITH. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1: That the Board of Rules and Appeals, provided for in the Miami Beach Building Code, is hereby authorized to vary and relax the provisions of the Miami Beach Building Code in applying it to buildings or structures to be erected on Fisher' s Island and Virginia Key; provided however that all requirements re- lating to the use of architects, engineers and contractors shall apply, as well as all requirements relating to permits, approvals and inspections; and provided further that such buildings or structures shall be adequate in their structural design and arrange- ment to resist wind forces of at least thirty (30) pounds per square foot. SECTION 2: That buildings or structures so erected under variances or relaxations shall be considered temporary, and shall be made to strictly conform to the requirements of the Building Code within a period of five (5) years from the date of issue of the permit, else be removed. SECTION 3: That all ordinances in conflict herewith are hereby re- pealed. SECTION 4: That this ordinance shall become effective immediately upon its passage and posting as required by law. D. , 1947, and that said Ordinance remained posted for a period of at least thirty days in accordance with the requirements of the City Charter of the said City of Miami Beach.
