Ordinance 821 ORDINANCE NO. 821 AN ORDINANCE AI'ENDING ORDINANCE NO. 496, ENTITLED: "AN ORDINANCE OF THE CITY OF MIAMI BEACH, FLORIDA, DEFINING THE AUTOMOBILE RENTING BUSINESS, IMPOSING A LICENSE TAX UPON THE BUSINESS OF RENTING AUTOMOBILES, PRESCRIBING • AN APPLICATION FOR LICENSE TO ENGAGE IN SUCH BUSINESS, PRESCRIBING AN IDENTIFICATION TAG OR STICKER TO BE ATTACHED TO ALL AUTOMOBILES RENTED BY LICENSEES AND PRESCRIBING PENALTIES FOR CARRYING ON OR ENGAGING IN SUCH BUSINESS WITHOUT A LICENSE OR OTHER FAILURE TO COMPLY WITH THE PRO- VISIONS HEREOF AND REPEALING ORDINANCES IN CONFLICT HERE- WITH". BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1: That Section 1 of Ordinance No. 496 of the City of Miami Beach, Florida, be and the same is hereby amended to read as follows: "SECTION 1: Every person, firm or corporation, who or which shall conduct, operate, or otherwise be engaged in the business or occupation of renting or leasing automo- biles in the City of Miami Beach, Florida, shall be subject to the terms and provisions of/ this ordinance." SECTION 2: That Section 2 of Ordinance No. 496 of the City of Miami Beach, Florida, be and the same is hereby amended to read as follows: "SECTION 2: It shall be unlawful for any person, firm or corporation to engage in, operate, or cause to be operated the business or occupation of renting or leasing automobiles, in any manner, in the City of Miami Beach, Florida, unless such person, firm or corporation shall have first procured a license from the City Clerk of the said City, which license shall be issued upon compliance with the provisions of this ordinance, and upon receipt of the amount herein provided for, or as may otherwise be provided by law; provided that the license so procured shall be issued for and shall apply only to the location and premises specifically designated in such * ,. license." SECTION 3: That Section 3 of Ordinance No. 496 of the City of Miami Beach, Florida, be and the same is hereby amended to read as follows: "SECTION 3: No license shall be issued to any person, firm or corporation to conduct or operate an automobile renting business unless such person, firm or corporation shall file with the City Clerk of the City of Miami Beach, an appli- cation for such license, in which application, such appli- cant shall state under oath the name of the person, firm or corporation to whom or to which such license is to be issued, the street address in the City of Miami Beach at which such business shall be operated, and the number of automobiles the applicant proposes to rent or lease, and upon the filing of such application, and compliance with the provisions of this ordinance, the City Clerk shall issue the said license upon the payment of a license fee in the sum of Five Hundred 01500.00) Dollars; provided, that if, after the issuance of the said license, the appli- cant desires to lease, rent or hire a greater number of automobiles than stated in said application, that a further application must be made and approved by the City Clerk be- fore it shall be lawful to operate a greater number of auto- mobiles under the said license." - 1 - It shall be unlawful for any person, firm or corporation, ,A holding a license to engage in the business of renting or leasing automobiles or any agent or employee of such per- son, firm or corporation, to place, keep, store or display, for the purpose of renting or leasing, or for the offering for rent or lease, any automobile in any location in the City of Miami Beach, except in the location specifically designated in such license." SECTION 4: That Section 8 of Ordinance No. 496 of the City of Miami Beach Florida, be and the same is hereby amended to read as follows: "SECTION 8: The City Clerk shall issue to every person, firm, and corporation licensed under the provisions of this ordi- nance to operate an automobile renting business, a sticker, label or metal medallion for each and every automobile rented, leased or hired by such licensee, and each and every such sticker, label or medallion shall bear the City license number of such licensee and the year for which such license shall have been issued, and shall be affixed in a conspicuous location on every autebile rented, leased or hired, or offered for rent, lease or hire, and it shall be unlawful for any person, firm or corporation to rent, lease or hire, or to offer for rent, lease or hire in any manner, any automobile, unless such automobile shall have affixed conspicuously to it, the said sticker, label or medallion." SECTION 5: That Section 9 of Ordinance No. 496 of the City of Miami Beach, Florida, be and the same is hereby amended to read as follows: "SECTION 9: That in the event of the sale of any automobile owned by any licensee, licensed under this ordinance, it shall be the duty of such licensee, before selling or transferring possession of such automobile, to remove therefrom the sticker, label or medallion provided for in Section 8 of this ordi- nance, and it shall be unlawful for any person, firm or cor- poration to drive or operate any automobile in the City of Miami Beach, having affixed to it said sticker, label or medallion, unless such driver or operator shall be a licensee, or the servant, agent or employee of such licensee, or unless such driver shall be a bona fide lessee of such automobile from a person, firm or corporation duly licensed under this ordinance." SECTION 6: That Section 11 of Ordinance No. 496 of the City of Miami Beach, Florida, be and the same is hereby amended to read as follows: ' "SECTION 11: No license shall be issued to any person, firm or corporation for the operation of an automobile renting business unless there has been issued to him by an insurancd carrier authorized to do business in this state, a public liability insurance policy or policies covering each such motor vehicle so rented in the amounts as hereinafter stated and insuring said person, firm or corporation, as owner, and every person operating such vehicles under a rental agreement or operating the vehicle with the express or implied permis- sion of the owner against loss from the liability imposed by law arising out of the operation of said vehicle in the amount of $5,000.00 for bodily injury to or death of one person and subject to said limit as respects bodily injury to or death of any one person in the amount of $10,000.00 on account of bodily injury to or death of more than one person in any one accident, and in the amount of $5,000.00 for damage to property of others in any one accident. The person, firm or corporation so licensed shall maintain such policy or policies in full force and effect during all times that such person, firm or corporation is engaged in the business of renting or leasing automobiles. Said policy or policies need not cover any liability incurred by the renter of any vehicle to any passenger in such vehicle. ., 2 - The form and substance of said policy shall be subject to the approval of the City Attorney. Before any license shall be issued, as provided in this ordinance, every applicant shall furnish to the City Clerk . satisfactory evidence that the applicant has obtained the insurance hereby required, and that the same is in full force and effect." SECTION 7: That Section 12 of Ordinance No. 496 of the City of Miami Beach, Florida, be and the same is hereby repealed and deleted. SECTION 8: That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 9: That this ordinance shall go into effect immediately upon its passage and posting as required by law. PASSED and ADOPTED this 15th day of October A.
