AN ORDINANCE AMENDING ORDINANCE NO. 215 ENTITLED:
"AN ORDINANCE OF THE CITY OF MIAMI BEACH, FLORIDA,
REGULATING THE FLIGHT AND LANDING OF AIR CRAFT
AND PROVIDING THE, PENALTY FOR THE VIOLATION HEREOF;"
EXEMPTING THEREFROM AIR CRAFT USED OR EMPLOYED BY
ANY GOVERNMENTAL AGENCY FOR THE PURPOSE OF SPRAYING
INSECTICIDES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA:
SECTION 1: That Section 1 of Ordinance No. 215 of the City of
Miami Beach, Florida, be amended so as to read as
follows:
"SECTION 1: That it shall be unlawful for
any person, firm or corporation to operate,
fly or cause to be operated an air -plane or
any other kind of air craft except a balloon
over any part of the City of Miami Beach,
Florida, at a height of less than 1000 feet
above the surface of land or water over which
such air -plane or craft may be operated or
flown; provided, however,nothing in this
ordinance shall regulate he altitude at which
air -planes or any other kind of air craft may
fly when such air craft are used or employed
by any governmental authority for the purpose
of spraying insecticides."
SECTION 2: That the welfare of the City is in peril and this
ordinance is hereby declared to be an emergency mea-
sure and to be necessary for the immediate preservation
of the public peace and the three readings thereof shall be had at
one session, and this ordinance shall go into effect immediately
upon its passage.

"AN ORDINANCE AMENDING ORDINANCE NO. 215 ENTITLED: 'AN ORDINANCE OF
THE CITY OF MIAMI BEACH, FLORIDA, REGULATING THE FLIGHT AND LANDING
OF AIR CRAFT AND PROVIDING THE PENALTY FOR THE VIOLATION HEREOF;
EXEMPTING THEREFROM AIR CRAFT USED OR EMPLOYED BY ANY GOVERNMENTAL
AGENCY FOR THE PURPOSE OF SPRAYING INSECTICIDES", having been passed
and adopted by the City Council of the City of Miami Beach, Florida,
has been posted by me in three conspicuous places in the City of
Miami Beach, one of which was at the door of the City Hall in said
City on the 21st day of July, A. D. 1949, and that said Ordinance re-
mained posted for a period of at least thirty days in accordance with
the requirements of the City Charter of the said City of Miami Beach.
IN WITNESS WHEREOF I have hereunto set my hand and affixed the
official seal of the City of Miami Beach, Florida, on this the 22nd
day of August, A. D. 1949.
