Ordinance 839 ORDINANCE NO .__832 AN ORDINANCE OF THE CITY OF MIAMI BEACH, • FLORIDA, AMENDING SECTION 6, OF ORDINANCE NO. 497 OF THE CITY OF MIAMI BEACH, FLORIDA, COMI:IONLY KNOWN AND DESIGNATED AS THE "ANTI- NOISE ORDINANCE" . BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY CF MMIAMI BEACH, FLORIDA: SECTION 1: That Section 6 of Ordinance No . 497 be and the same is hereby amended to read as follows: "The "Restricted Noises" included in Groups "A" and "B", as set forth in Section 3 of this ordinance, are hereby prohibited within fifty ( 50 ) yards of the nearest point of any building occupied as a Hotel or apartment as defined in Ordinance No . 289 of the City of Miami Boach, Florida, at all hours during the period of time referred to and described in Section 4 of this ordinance as Period No. ' l. SECTION 2: That all ordinances and parts of ordinances in con- flict herewith are repealed. SECTION 3: If any section, sub-section, sentence, clause or phrase of this Ordinance is for any reason heldto be unconstitutional, such decision shall not affect the validity of the remaining portions of this Ordinance, which shall remain in effect as if the unconstitutional portion or portions have not been included. SECTION 4: That the welfare of the city is in peril, and this ordinance is hereby declared to be an emergency measure, and therefore necessary for the immediate preservation of the public peace, and the three readings thereof shall be had at one session, and this ordinance shall go into effect immediately upon its passage. D. 1948, and that said Ordinance remained posted for a period of at least thirty days in accordance with the requirements of the City Charter of the City of Miami Beach.
